Pending Applications

North Carolina Administrative Code 15A NCAC 02H.0503 requires the Division to provide public notice of each pending application for an individual certification.  This requirement is satisfied by a joint notice with the U.S. Army Corps of Engineers or the Division of Coastal Management.

Name: Public Hearing for Mitigation Program Requirements for Protection and Maintenance of Riparian Buffers

WHERE: Archdale Building Ground Floor Hearing Room, 512 N. Salisbury St., Raleigh, NC 27604 WHEN: 7 p.m. WHY:These proposed rule changes in Rule 2B .0295 will provide mitigation options not currently available to DOT, developers, and private individuals. In addition to providing greater regulatory flexibility, the proposed changes incorporate contemporary technical and operational techniques into the rules. These proposed amendments were developed through a public stakeholder process, advance the public interest and are designed to achieve their objectives in a cost-effective and timely manner. The division also seeks to repeal the current buffer mitigation rules (2B .0242, .0244, .0252, .0260, .0268, and .0609), since they are proposed to be consolidated and replaced by 15A NCAC .02B .0295, "Mitigation Program Requirements for Protection and Maintenance of Riparian Buffers". The purpose of this consolidation is to bring consistency to the current riparian buffer mitigation rules. A reduction in the number of rules is in the public interest and consistent with the principles of Executive Order 70.
