Abstract:

The General Assembly in 1965 enacted legislation (G.S. § 113-205 and G.S. § 113-206) requiring registration of private claims to lands beneath navigable waters in 25 coastal counties. This dataset contains recognized claims i.e. where a final claim resolution has been issued.

Purpose:

GIS dataset was created to identify location and associated information of recognized claims.

Supplemental_Information:

This dataset is not a certified land survey and is not intended to comply with North Carolina G.S. §47-30.

This dataset, prepared pursuant to North Carolina General Statute § 113-206(a), depicts claims to lands under navigable waters for which a final resolution has been issued pursuant to North Carolina General Statute § 113-206. THIS DATASET IS NOT A CERTIFIED LAND SURVEY AND IS NOT INTENDED TO COMPLY WITH NORTH CAROLINA GENERAL STATUTE § 47-30. This dataset is prepared for informational purposes only. The information depicted was obtained from the claimed files, which the Division of Marine Fisheries maintains for its internal use. The Division makes no warranty, expressed or implied, concerning the accuracy, completeness, reliability of these data, and users are advised that use of this data is at their own risk. This data is not to be used for legal descriptions or property transfers. Its intent is to provide location and quantitative information as a management tool for natural resources in those areas where a claim to a limited property interest registered pursuant to North Carolina General Statute § 113-205 may have been recognized. This GIS dataset represents data which existed at the time the claim was resolved. While every effort has been made to achieve accuracy, users are advised that the thousands of deeds, plats, maps and other documents registered varied greatly in scale, quality, and clarity. Claim boundaries were adjusted and registered to overlay 1998 DOQCIR Photography. Map projection is North Carolina State Plane, and the datum is North American Datum 83. For detailed legal description, title information, or survey data, claim boundaries should be researched in the appropriate Office of the Register of Deeds. A Declaration of Final Resolution of Claim to Submerged Lands has been filed in the Register of Deeds of the County where the land is located.

The dataset has been prepared from various sources: county parcel maps, surveyed plat maps and hand drawn maps over aerial photos. The positional accuracy varies widely across the dataset, however a general visual assessment has been made by overlaying the dataset with county parcel maps, county boundaries, street maps, water body datasets, aerial photos, and Google Earth to verify the general location accuracy and alignment..

Submerged Lands Feature class has information related to Original Claimants.
ORIGINAL CLAIMANT is a person claiming an interest to any part of the bed, or right of fishery, in navigable waters superior to that of the general public, who registered a claim pursuant to N.C. General Statute 113-205 on or before January 1, 1970.
CURRENT CLAIMANT is a person who was a successor in interest to an Original Claimant at the time the validity of the claim was resolved. For purposes of this dataset, persons designated as “Current Claimants” whose claims were recognized and mapped may have transferred their interest and no longer have an interest in the property. Land records in the county where the claim is located should be consulted to determine the present owner.
The following are the five different categories of Submerged Lands Claims:
1. SHELLFISH (SF): The claim is for an exclusive right to cultivate and harvest shellfish, usually premised on a “grant of perpetual franchise.” These are variously called "deeded bottoms," "oyster bottoms," or "oyster gardens." These are distinct from shellfish cultivation leases issued under N.C. Gen. Stat. § 113-202, for which claim registration was not required.
2. WHARF EASEMENT (WE): The claim is for an easement for wharf purposes, premised on a wharf grant issued to the riparian owner.
3. BOARD OF EDUCATION (BE): The claim is for the bed of regularly flooded estuarine marshland, premised upon a deed issued by the State Board of Education.
4. Private Bed (PB): A claim for exclusive ownership of submerged bottom created from an excavated highland.
5. Seine Fishing Easement(SFE): Area designated for exclusive use of seine fishing that was acquired by a grant from the State.
