PROCLAMATION
RE: SHELLFISH POLLUTED AREA
Dr. Louis B. Daniel III, Director, Division of Marine Fisheries, upon the recommendation of Jeffrey P. Engel, M.D., State Health Director, Department of Health and Human Services, hereby announces that the following shellfish area closures will take effect immediately:
No person shall take or attempt to take any oysters, clams or mussels or possess, sell or offer for sale any oysters, clams or mussels taken from the following polluted areas:
The following areas in Brunswick and Carteret Counties that were opened to shellfish harvesting on a temporary basis shall return to the status in existence immediately prior to the December 17, 2011 and December 22, 2011 temporary openings:
BRUNSWICK / CARTERET COUNTIES
Jinks Creek Area - All those waters in Jinks Creek bounded on the north by a straight line beginning at a point on the north shore at 33º 52.8453' N -78º 29.9304' W; running southwesterly to a point on the south shore at 33º 52.7908' N -78º 29.9624' W and bounded on the south by a straight line beginning at a point on the west shore at 33º 52.6729' N -78º 29.6735' W; running northeasterly in a straight line to a point on the east shore at 33º 52.7393' N -78º 29.6339' W.
Newport River - All those waters in Newport River bounded on the west by a straight line beginning at a point on the north shore at 34º 45.8045' N -76º 45.2811' W; running southeasterly to a point on the south shore at 34º 44.8039' N -76º 44.9236' W and bounded on the east by a straight line beginning at a point on the north shore at 34º 46.0253' N -76º 45.0627' W; running southeasterly in a straight line to a point on the south shore at 34º 45.5461' N -76º 44.1308' W near Lawton Point.
Harlowe Creek - All those waters in Harlowe Creek downstream of a straight line beginning at a point on the west shore at 34º 46.9614' N -76º 43.5843' W; running easterly to a point on the east shore at 34º 46.9624' N -76º 43.3476' W.
GENERAL INFORMATION:
A. This proclamation is issued under the authority of N.C.G.S. 113-170.4; 113-170.5; 113-182; 113-221.1; 143B-289.52 and N.C. Marine Fisheries Rules 15A NCAC 03H . 0103 and 03K .0101.
B. It is unlawful to violate the provisions of any proclamation issued by the N.C. Fisheries Director under his delegated authority pursuant to N.C. Marine Fisheries Rule 15A NCAC 03H .0103.
C. These closures are due to rainfall exceeding management plan criteria.
