RE: SHELLFISH POLLUTED AREA
Dr. Louis B. Daniel III, Director, Division of Marine Fisheries, upon the recommendation of Jeffrey P. Engel, M.D., M.P.H., State Health Director, Department of Health and Human Services, hereby announces that the following shellfish area closures will take effect immediately:
No person shall take or attempt to take any oysters, clams or mussels or possess, sell or offer for sale any oysters, clams or mussels taken from the following polluted areas:
The following changes are closures to shellfish harvesting:
BRUNSWICK / NEW HANOVER / CARTERET COUNTIES
SHALLOTTE RIVER AREA (A-2) – A-2 Map 49 2011
a) Shallotte River – All those waters upstream of a line in Shallotte River beginning at a point 33º 55.6349' N -78º 22.1888' W on the west shore; running northeasterly to a point 33º 55.8313' N -78º 21.6896' W on the east shore near Shell Point, to include the Swash.
b) Intracoastal Waterway area – All those waters bordered on the west by a straight line beginning at a point 33º 55.0142' N -78º 18.6277' W on the northern shore of the IWW; running southerly to a point 33º 54.8933' N -78º 18.6298' W on the southern shore of the IWW; and bordered on the east by a straight line beginning at a point 33º 55.0116' N -78º 18.2718' W on the northern shore of the IWW; running southerly to a point 33º 54.9287' N -78º 18.2735' W on the southern shore of the IWW; to include the canals near Starfish Drive on Holden Beach.
k) Shallotte Creek- All those waters in Shallotte Creek upstream of a straight line across the mouth beginning at a point 33º 55.7467' N -78º 21.6412' W on the north shore; running southeasterly to a point 33º 55.6022' N -78º 21.5270' W on the southern shore near Windy Point.
MYRTLE GROVE SOUND AREA (B-5) – B-5 Map 46 2011
e) Inlet Watch Yacht Club - All those waters within the Inlet Watch Yacht Club basin and extending 450 feet beyond the dockage facilities beginning at a point 34º 04.7071' N -77º 53.1271' W on the shore north of the entrance canal; running easterly to a point 34º 04.7005' N -77º 53.0807' W in the sound; running southerly to a point 34º 04.6239' N -77º 53.0963' W in the sound; running westerly to a point 34º 04.6379' N -77º 53.1962' W on the shore south of the entrance canal.

j) Figure 8 Island Marina - All those waters at Figure 8 Island Marina extending 200 feet beyond the dockage facilities beginning at a point 34º 16.2853' N -77º 45.0054' W on the shore west of the marina; running northeasterly to a point 34º 16.3565' N -77º 44.9794' W; running southeasterly to a point 34º 16.3148' N -77º 44.8122' W; running southwesterly to a point 34º 16.2252' N -77º 44.8445' W on the shore east of the marina.
NORTH RIVER AREA (E-6) – E-6 Map 28_2011
d) North Leopard Creek- All those waters in North Leopard Creek upstream of a straight line beginning at a point 34º 45.9918' N -76º 34.1122' W on the north shore; running southerly to a point 34º 45.8677' N -76º 34.1308' W on the southern shore.
k) Sam Moss Creek Area - All those waters upstream of a straight line beginning at a point 34º 47.5005' N -76º 36.2045' W on the north shore; running southwesterly to a point 34º 47.4091' N -76º 36.2586' W on the south shore near Highway 70.
A. This proclamation is issued under the authority of N.C.G.S. 113-170.4; 113-170.5; 113-182; 113-221.1; 143B-289.52 and N.C. Marine Fisheries Rules 15A NCAC 03H .0103 and 03K .0101.
B. It is unlawful to violate the provisions of any proclamation issued by the N.C. Fisheries Director under his delegated authority pursuant to N.C. Marine Fisheries Rule 15A NCAC 03H .0103.
C. This proclamation amends N.C. Marine Fisheries Proclamation PA-3-2009, Map 49, (49) (a), (49) (b) and, by the addition of (49) (k), closes approximately 191 acres. It also amends Proclamation PA-63-2008, (46) (e) and Map 46, and closes approximately 1 acre. Proclamation PA-63-2008, (44) (j) and Map 46, and closes approximately 1 acre, and Proclamation PA-89-2010, Map 28, (28) (d) and, by the addition, of (28) (k) closes approximately 29 acres.
D. These closures are due to recent sanitary surveys in the Shallotte River area of Brunswick County, the Myrtle Grove Sound and Wrightsville Beach areas of New Hanover County, and the North River area of Carteret County.
