PROCLAMATION

RE: SHELLFISH POLLUTED AREA

Dr. Louis B. Daniel III, Director, Division of Marine Fisheries, upon the recommendation of Jeffrey P. Engel, M.D., State Health Director, Department of Health and Human Services, hereby announces that the following change in shellfish harvesting areas will take effect at sunrise, Sunday, January 30, 2011.

All those waters in Pender and Onslow Counties will return to the status in existence immediately prior to the January 18 and January 26, 2011 temporary closures except the following which will remain closed:

ONSLOW COUNTY

Freeman Creek – All those waters in Freeman Creek upstream of a straight line across the mouth.

Queens Creek – All those waters in Queens Creek upstream of a straight line across the mouth.

Bear Creek – All those waters in Bear Creek upstream of a straight line across the mouth.

White Oak River – All those waters in White Oak River upstream of the Highway 24 Bridge at Swansboro.

The following also remains closed:

CARTERET COUNTY

White Oak River – All those waters in White Oak River upstream of the Highway 24 Bridge at Swansboro.

Broad Creek area – All those waters from the Intracoastal Waterway to the mainland between Fl. Beacon #25 and IWW Marker #27.

Newport River - All those waters in Newport River upstream of the Highway 70 High Rise Bridge and Morehead-Beaufort Causeway, to include all tributaries and Core Creek.

North River - All those waters in North River upstream of a line across the River beginning at the Oyster House on the west shore; thence in a straight line to the north shore of the mouth of Ward Creek.

Ward Creek - upstream of the mouth of Ward Creek beginning on the north shore at a point 34° 46.2667’ N – 76° 35.4933 W; running southerly to the south shore to a point 34° 45 .4517’ N – 76° 35.1767’ W.

Whitehurst Creek - All those waters in Whitehurst Creek upstream of a straight line across the mouth.

Sleepy Creek – All those waters in Sleepy Creek upstream of a straight line across the mouth.

Jarrett Bay – All those waters upstream of a line beginning at a point on the east shore of Spit Bay; thence in a straight line to the southern end of Davis Island; thence in a straight line through Flashing Beacon #36; thence in a straight line to the southeast end of Bells Island; thence in a straight line to a point on the Marshallberg shoreline.

GENERAL INFORMATION:

A. This proclamation is issued under the authority of N.C.G.S. 113-170.4; 113-170.5; 113-182; 113-221.1; 143B-289.52 and N.C. Marine Fisheries Rules 15A NCAC 03H .0103 and 03K .0101.

B. It is unlawful to violate the provisions of any proclamation issued by the N.C. Fisheries Director under his delegated authority pursuant to N.C. Marine Fisheries Rule 15A NCAC 03H .0103.

C. This proclamation returns the following areas to normal closure boundaries: Stump Sound and Chadwick Bay.

D. These reopenings are due to satisfactory bacteriological sampling results.
