PROCLAMATION

RE: 2012 SHRIMPING AND CRAB TRAWLING

Dr. Louis B. Daniel III, Director, Division of Marine Fisheries, hereby announces that the following areas WILL OPEN to shrimping and crab trawling effective at 8:00 A.M., Friday, September 21, 2012.

I. AREA DESCRIPTION

BRUNSWICK COUNTY

Cape Fear River –south of a line starting on the west bank at 35 58.191’ N – 77 57.569’ W running easterly through the four legged marker south of Bird Island to a point on the east bank at 35 59.191’ N – 77 57.910’ W. Those areas known as the Junkyard, By-Pass, Triangle, Sugarloaf, Long Tow, Dow Chemical Bay and Radar Dome Bay WILL REMAIN CLOSED (See Map).

Elizabeth River – main channel only, including Lower Dutchman Creek from the ICW to the Cape Fear River. All tributaries of Elizabeth River and Dutchman Creek, that portion of Elizabeth River west of the ICW Marker #7, and that portion of Dutchman Creek north of the ICW WILL REMAIN CLOSED.

II. GENERAL INFORMATION:

A. This proclamation is issued under the authority of N.C.G.S. 113-170.4; 113-170.5; 113-182; 113-221.1; 143B-289.52 and N.C. Marine Fisheries Commission Rules 15A NCAC 03H .0103, 03L .0101 and .0202.

B. It is unlawful to violate the provisions of any proclamation issued by the Fisheries Director under his delegated authority pursuant to N.C. Marine Fisheries Commission Rule 15A NCAC 03H .0103.

C. All shellfish leases and franchises will remain closed to trawling as per N.C. Marine Fisheries Commission Rule NCAC 15A 030 .0211.

D. This proclamation supersedes portions of SH-9-2012, dated August 30, 2012, which opened these areas.
