RE: CRAB TRAWLING AND TAKING SHRIMP WITH NETS – SOUTHERN AREAS
Dr. Louis B. Daniel III, Director, Division of Marine Fisheries, hereby announces the following areas will close to shrimp and crab trawls and taking shrimp with nets effective at 5:00 P.M., Thursday, June 18, 2015.
I. AREA DESCRIPTION
A. Intracoastal Waterway - main channel only from IWW Marker # 1 at Southport to the Sunset Beach High Rise Bridge.
B. Cape Fear River - north and west of a line beginning at a point 33° 57.8020’ N - 77° 56.3990’ W on the east shore of the Cape Fear River north of the Fort Fisher Ferry Slip; running northwesterly to a point 33° 58.1920’ N - 77° 56.8230’ W near the four legged marker “27”; running west to a point 33° 58.1850’ N - 77° 57.4100’ W on the north end of Horseshoe Shoal Spoil Island; running southwesterly along the east shore of the spoil island to a point 33° 57.1630’ N - 77° 58.2010’ W on the south end of Horseshoe Shoal Spoil Island; running southwesterly to a point 33° 56.0560’ N - 77° 59.1460’ W on the offshore end of the Archer Daniels Midland Company pier; running northwesterly along the south side of the pier to a point 33° 56.2170’ N - 77° 59.3320’ W at the inshore end of the pier. II. MEANS AND METHODS
A. It is unlawful to take crabs with trawls.
B. It is unlawful to take shrimp with nets except:
1. Cast nets in accordance with N.C. Marine Fisheries Commission Rule 15A NCAC 03L .0105;
2. Pound nets permitted in accordance with N.C. Marine Fisheries Commission Rule 15A NCAC 03J .0502;
3. Pound nets authorized for use in accordance with N.C. Marine Fisheries Commission Rule 15A NCAC 03O .0302;
4. Fixed or stationary gill nets in accordance with N.C. Marine Fisheries Commission Rule 15A NCAC 03J .0103.
III. GENERAL INFORMATION
A. This proclamation is issued under the authority of N.C. General Statutes 113-170.4; 113-170.5; 113-182; 113-221.1; 143B-289.52 and N.C. Marine Fisheries Commission Rules 15A NCAC 03H .0103, 03L .0101, .0201 and 0202.
B. It is unlawful to violate the provisions of any proclamation issued by the Fisheries Director under his delegated authority pursuant to N.C. Marine Fisheries Commission Rule 15A NCAC 03H .0103.
C. The intent of this proclamation is to protect small juvenile brown shrimp.
D. It is unlawful to take or possess more than four quarts (heads on), or two and one-half quarts (heads off), of shrimp per person per day with a cast net from areas closed to the taking of shrimp in accordance with N.C. Marine Fisheries Commission Rule 15A NCAC 03L .0105 (2).
E. Taking shrimp with pots is not governed by this proclamation. Shrimp pots may be used to take shrimp in accordance with N.C. Marine Fisheries Commission Rule 15A NCAC 03J .0301.

G. In accordance with N.C. General Statute 113-221.1(c) all persons who may be affected by proclamations issued by the Fisheries Director are under a duty to keep themselves informed of current proclamations.
H. N.C. Marine Fisheries Commission Rules 15A NCAC 03L .0102 and .0103 place further restrictions on gear and time for the taking of shrimp with nets.
I. In accordance with N.C. Marine Fisheries Commission Rule 15A NCAC 03R .0106, the following waterbodies are closed to trawling; the Rocks, the Basin, Second Bay, Buzzard’s Bay, Cape Creek and Bald Head Creek.
J. This proclamation supersedes portions of SH-3-2015 (REVISED), dated May 13, 2015, that opened the areas described in section I above. It closes sections of the lower Cape Fear River and the IWW channel in Brunswick County to crab trawling and the taking of shrimp with nets.
