PROCLAMATION

RE: SHELLFISH MANAGEMENT AREA


This proclamation supersedes proclamation SF-6-2013, dated July 8, 2013. This proclamation sets boundaries for five Oyster Sanctuaries and designates them as Shellfish Management Areas. Within these boundaries, shellfish harvest and gear type restrictions are applied.

Stephen W. Murphy, Director, Division of Marine Fisheries, hereby announces that effective at 12:01 A.M., Monday, April 8, 2019, the following areas are declared SHELLFISH MANAGEMENT AREAS and ARE CLOSED to all oyster and clam harvest. Trawl net, long haul seine, and swipe net gears are also prohibited in the following areas.

I. AREA DESCRIPTIONS

A. Long Shoal Oyster Sanctuary: A 10-acre site as shown on Map 1. The area is delineated by oyster sanctuary buoy/day beacons. The locations of the buoy/day beacons are as follows:

35° 33.8600’   N 75° 49.9000’ W

B. Pea Island Oyster Sanctuary: A 47 acre site as shown on Map 2. The area is delineated by oyster sanctuary buoy/day beacons. The locations of the buoy/day beacons are as follows:

35° 40.080’   N 75° 36.800’ W
35° 39.840’   N 75° 36.800’ W
35° 39.840’   N 75° 37.080’ W
35° 40.080’   N 75° 37.080’ W

C. Raccoon Island Oyster Sanctuary: A 10-acre site as shown on Map 3. The area is delineated by oyster sanctuary buoy/day beacons. The locations of the buoy/day beacons are as follows:

D. Swan Island Oyster Sanctuary: A 60-acre site as shown on Map 4. The area is delineated by oyster sanctuary buoy/day beacons. The locations of the buoy/day beacons are as follows:

E. Little Creek Oyster Sanctuary: A 21-acre site as shown on Map 5. The area is delineated by oyster sanctuary buoy/day beacons. The locations of the buoy/day beacons are as follows:

II. GENERAL INFORMATION

A. This proclamation is issued under the authority of G.S. 113-170.4; 113-170.5; 113-182; 113- 221.1; 143B-289.52; and N.C. Marine Fisheries Commission Rules 15A NCAC 03H .0103 and 03K .0103.

B. It is unlawful to violate provisions of any proclamation issued by the Fisheries Director under his delegated authority per N.C. Marine Fisheries Commission Rule15A NCAC 03H .0103.

C. The intent of this proclamation is to designate shellfish management areas to enhance oyster growth and reproduction under protected conditions which should benefit oyster production in these areas.

D. The Division of Marine Fisheries will mark the affected areas with day beacons and/or buoys indicating ‘Oyster Sanctuary” insofar as may be practicable. No unauthorized removal or relocation of any such day beacons or buoys shall have the effect of changing the boundaries, nor shall any such day beacons or buoys affect the applicability of any proclamation or portion
thereof. Where there is conflict between day beacons, buoys, maps, and proclamation, proclamation shall prevail.

E. In accordance with N.C. General Statute 113-221.1(c) All persons who may be affected by proclamations issued by the Fisheries Director are under a duty to keep themselves informed of current proclamations.
