PROCLAMATION
RE: RESEARCH SANCTUARY
Dr. Louis B. Daniel III, Director, Division of Marine Fisheries, hereby announces that effective at 8:00 A.M., Monday, November 5, 2012, the following areas are declared RESEARCH SANCTUARIES and ARE CLOSED to all fishing equipment:
I. AREA DESCRIPTIONS
ONSLOW COUNTY
Fannie & Wheeler Creeks - Upper New River - In the upper New River (at the mouths of Fannie & Wheeler Creek). An area consisting of approximately 6 acres in size and delineated by six pilings with signs as shown below. The locations of the pilings are as follows:
1. 34° 34.2270’ N 77° 23.4440’ W
2. 34° 34.2090’ N 77° 23.3660’ W
3. 34° 34.1860’ N 77° 23.2860’ W
4. 34° 34.1630’ N 77° 23.3040’ W
5. 34° 34.1870' N 77° 23.3720' W
6. 34° 34.2150' N 77° 23.4560' W
Kings Creek – Stump Sound - northwest of ICWW Marker 41, Kings Creek is in Spicers Bay. This area consists of approximately 1.20 acres and is delineated by four pilings and signs as shown in the attached map. The location of the pilings are as follows:
1. 34° 28.8120’ N 77° 29.3660’ W
2. 34° 28.8020’ N 77° 29.3630’ W
3. 34° 28.7750’ N 77° 29.4110’ W
4. 34° 28.7920’ N 77° 29.3000’ W
Settler's Beach Canals - In closed shellfishing waters off the 1st and 9th Street Canals (Settler’s Beach Canals) north of Surf City.
Reef #1 is an area consisting of approximately 15,400 square feet and is delineated by four pilings and signs as shown in the upper center of the attached map. The location of the pilings are as follows:
1. 34° 27.1370’ N 77° 31.3040’ W
2. 34° 27.1370’ N 77° 31.3200’ W
3. 34° 27.0930’ N 77° 31.3130’ W
4. 34° 27.0950’ N 77° 31.3070’ W
Reef #2 is an area consisting of approximately 20,500 square feet and is delineated by four pilings and signs as shown in the lower center of the attached map. The location of the pilings are as follows:
1. 34° 26.8660' N 77° 31.3000' W
2. 34° 26.8630' N 77° 31.3280' W
3. 34° 26.8490' N 77° 31.3230' W
4. 34° 26.8480' N 77° 31.2890' W
NEW HANOVER COUNTY
Hewletts Creek - mouth of Hewletts Creek. An area consisting of approximately one acre in size and is delineated by four pilings and signs as shown on the attached map. The location of the pilings are as follows:
1. 34° 10.7950' N 77° 50.5516' W
2. 34° 10.7916' N 77° 50.5350' W
3. 34° 10.7183' N 77° 50.6000' W
4. 34° 10.7083' N 77° 50.5750' W
Dick's Bay - Between the ICW and Masonboro Island, and north of Carolina Beach Inlet. An area consisting of approximately 3.7 acres in size and is delineated by four pilings and signs as shown on the attached map. The location of the pilings are as follows:
1. 34° 05.6918' N 77° 52.3578' W
2. 34° 05.7140' N 77° 52.3055' W
3. 34° 05.6486' N 77° 52.2533' W
4. 34° 05.6174' N 77° 52.3217' W
II. GENERAL INFORMATION:
A. This proclamation is issued under the authority of N.C.G.S. 113-170.4; 113-182; 113-221.1; 143B-289.52; and N.C. Marine Fisheries Commission Rules 15A NCAC 03H .0103 and 03I .0109.
B. It is unlawful to violate provisions of any proclamation issued by the Fisheries Director under his delegated authority pursuant to N.C. Marine Fisheries Commission Rule 15A NCAC 03H .0103.
C. The sanctuaries will be used by the North Carolina Coastal Federation to conduct research on oyster larvae/spat growth and survival.
D. N.C. Marine Fisheries Commission Rule 15A NCAC 03I .0109, specifies that these Research Sanctuaries are in effect for one year, subject to renewal at the end of that year.
