PROCLAMATION

RE: RESEARCH SANCTUARY


Dr. Louis B. Daniel III, Director, Division of Marine Fisheries, hereby announces that effective at 9:00 A.M. Saturday, October 28, 2011, the following areas will be declared a RESEARCH SANCTUARY and close to the taking of shellfish:

I. AREA DESCRIPTION:
NEW HANOVER COUNTY

Dick’s Bay

An area between the ICW and Masonboro Island, and is north of Carolina Beach Inlet. The area is approximately 3.7 acres in size and is delineated by four pilings and signs as shown on the attached Map 1. The location of the pilings are as follows:

1.    34º 05.6918’N - 77º 52.3578’W
2.    34º 05.7140’N - 77º 52.3055’W
3.    34º 05.6486’N - 77º 52.2533’W
4.    34º 05.6174’N - 77º 52.3217’W 

Hewletts Creek
An area of approximately one acre in size and is delineated by four pilings and signs as shown on attached Map 2. The location of the pilings are as follows:

1.    34° 10.7950’N – 77° 50.5516’W
2.    34° 10.7916’N – 77° 50.5350’W
3.    34° 10.7183’N – 77° 50.6000’W
4.    34° 10.7083’N – 77° 50.5750’W

ONSLOW COUNTY
Stump Sound, Northwest of ICWW Marker 41, Kings Creek in Spicers Bay
An area of approximately one acre northwest of IWW marker 41 delineated by stakes and signs at the following locations:

1.    34° 28.8120’N – 77° 29.3660’W
2.    34° 28.8020’N – 77° 29.3630’W
3.    34° 28.7750‘N – 77° 29.4110’W
4.    34° 28.7920’N – 77° 29.3000’W

Fannie and Wheeler Creek – Upper New River
In New River at the mouths of Fannie and Wheeler Creeks. The area is approximately six acres in size and is delineated by six pilings and signs as shown on the attached Map 3. The locations of the pilings are as follows:

1. 34º 34.2270’N - 77º 23.4440’W
2. 34º 34.2090’N - 77º 23.3660’W
3. 34º 34.1860’N - 77º 23.2860’W
4. 34º 34.1630’N - 77º 23.3040’W   
5. 34º 34.1870’N - 77º 23.3720’W
6. 34º 34.2150’N - 77º 23.4560’W

II. GENERAL INFORMATION:

A. This proclamation is issued under the authority of G.S. 113-170.4; 113-170.5; 113-182; 113-221.1; 143B-289.52; and N.C. Marine Fisheries Rules 15A NCAC 03H .0103 and 03I .0109.

B. It is unlawful to violate provisions of any proclamation issued by the Fisheries Director under his delegated authority pursuant to N.C. Marine Fisheries Rule 15A NCAC 03H .0103.
   
C. These areas will be used by the North Carolina Coastal Federation to conduct research on oyster larvae/spat growth and survival.

D. N.C. Marine Fisheries Rule 15A NCAC 03I .0109, specifies that Research Sanctuaries may be in effect for one year, subject to renewal at the end of that year.
