PROCLAMATION

RE: RESEARCH SANCTUARY

Dr. Louis B. Daniel III, Director, Division of Marine Fisheries, hereby announces that effective at 12:01 A.M., Monday, September 14, 2015, the following restrictions implemented by proclamation RS-4-2015 are rescinded:

The following area is declared a RESEARCH SANCTUARY and IS CLOSED to all fishing equipment and the taking of fish (including shellfish) until 8:00 A.M., Monday, April 18, 2016:

I. AREA DESCRIPTION

CARTERET COUNTY

Newport River - An area consisting of approximately 1.40 acres northwest of the Michael J. Smith Field Airport as shown on the attached map (RS-4-2015(RESCINDED)). The area is delineated by four posts with signs. The locations of the posts are as follows:

1. 34° 44.4830’ N 76° 40.3690’ W
2. 34° 44.4840’ N 76° 40.3120’ W
3. 34° 44.4480’ N 76° 40.3680’ W
4. 34° 44.4490’ N 76° 40.3120’ W

II. GENERAL INFORMATION:

A. This proclamation is issued under the authority of N.C.G.S. 113-170.4; 113-182; 113-221.1; 143B-289.52; and N.C. Marine Fisheries Commission Rules 15A NCAC 03H .0103 and 03I .0109.

B. It is unlawful to violate provisions of any proclamation issued by the Fisheries Director under his delegated authority pursuant to N.C. Marine Fisheries Commission Rule 15A NCAC 03H .0103.

C. This sanctuary will be used by the UNC Institute of Marine Sciences for research purposes.

D. In accordance with N.C. Marine Fisheries Commission Rule 15A NCAC 03I .0109, any closure or restrictions associated with research sanctuaries shall be for no more than one year, subject to renewal at the discretion of the Director.

E. In accordance with N.C. General Statute 113-221.1(c) All persons who may be affected by proclamations issued by the Fisheries Director are under a duty to keep themselves informed of current proclamations.

G. RS-4-2015 is being rescinded effective 12:01 A.M., Monday, September 14, 2015. The UNC Institute of Marine Sciences is no longer utilizing this area for research. The research sanctuary designation for this area is voided and the area is henceforth subject to all applicable management rules and proclamations.
