PROCLAMATION

RE: RESEARCH SANCTUARY- BACK SOUND - UNC-INSTITUTE OF MARINE SCIENCE

This proclamation establishes a closure to all fishing gear in a Research Sanctuary in three locations in Back Sound.

Stephen W. Murphey, Director, Division of Marine Fisheries, hereby announces that effective at 12:01 A.M., Monday, March 11, 2019, in the area described below, the following restrictions apply:

I. AREA DESCRIPTION

CARTERET COUNTY
Behind Harker’s Island two areas are located in the Rachel Carson Estuarine Reserve and one area is located near Morgan Island in Back Sound. The total area for all three sites is approximately 3.6 acres in size and is delineated by pilings and signs as shown on the attached map. The location of the sites and their pilings are as follows:

Site 1 (1.163 acres): Piling 1 34° 41.3670'N 076° 37.0670'W
  Piling 2 34° 41.3830'N 076° 37.0000'W
  Piling 3 34° 41.3500'N 076° 37.0330'W
  Piling 4 34° 41.3670'N 076° 36.9670’W
     
Site 2 (1.259 acres): Piling 1 34° 41.8500'N 076° 35.7500'W
  Piling 2 34° 41.8670N 076° 35.7000'W
  Piling 3 34° 41.8170'N 076° 35.7170'W
  Piling 4 34° 41.8330'N 076° 35.6830’W
     
Site 3 (1.163 acres): Piling 1 34° 39.7170'N 076° 31.6830'W
  Piling 2 34° 39.7500'N 076° 31.6500'W
  Piling 3 34° 39.7000'N 076° 31.6500'W
  Piling 4 34° 39.7170'N 076° 31.6170’W

II. RESTRICTIONS

A. It is unlawful to use fishing gear in the areas described in I.

B. It is unlawful to take shellfish in the areas described in I.

III. GENERAL INFORMATION

A. This proclamation is issued under the authority of N.C.G.S. 113-170.4; 113-170.5; 113-182; 113-221.1; 143B-289.52; and N.C. Marine Fisheries Commission Rules 15A NCAC 03H .0103 and 03I .0109.

B. It is unlawful to violate provisions of any proclamation issued by the Fisheries Director under his delegated authority pursuant to N.C. Marine Fisheries Commission Rule 15A NCAC 03H .0103.

C. This area will be used by the UNC-Institute for Marine Science to conduct research on seagrass restoration.

E. In accordance with N.C. General Statute 113-221.1(c) All persons who may be affected by proclamations issued by the Fisheries Director are under a duty to keep themselves informed of current proclamations.

F. In accordance with N.C. Marine Fisheries Commission Rule 15A NCAC 03I .0109 (a) (2), any closure or restriction in the Research Sanctuary shall be for no more than one year, subject to renewal at the discretion of the Fisheries Director.

G. This proclamation establishes a closure to all fishing gear in a Research Sanctuary in three locations in Back Sound.
