PROCLAMATION

RE: SHELLFISH POLLUTED AREA

Braxton C. Davis, Director, Division of Marine Fisheries, upon the recommendation of Dr. Randall Williams, M.D., State Health Director, Department of Health and Human Services, hereby announces that effective at sunrise, Wednesday, March 1, 2017, this proclamation supersedes all proclamations affecting permanently closed shellfish harvesting areas and brings together in one document all areas which are permanently closed to shellfish harvesting:

It is unlawful for any person to take or attempt to take any oysters, clams or mussels or possess, sell or offer for sale any oysters, clams or mussels taken from the following polluted areas:

GENERAL INFORMATION:

A. This proclamation is issued under the authority of N.C.G.S. 113-170.4; 113-170.5; 113-182; 113-221.1; 143B-289.52 and N.C. Marine Fisheries Commission Rules 15A NCAC 03H . 0103 and 03K .0101.

B. It is unlawful to violate the provisions of any proclamation issued by the N.C. Fisheries Director under his delegated authority pursuant to N.C. Marine Fisheries Commission Rule 15A NCAC 03H .0103.

C. In accordance with N.C. General Statute 113-221.1(c) all persons who may be affected by proclamations issued by the Fisheries Director are under a duty to keep themselves informed of current proclamations.

D. The Division of Marine Fisheries will mark the areas to be closed with signs insofar as may be practicable. No unauthorized removal or relocation of any such sign shall have the effect of changing the areas closed, nor shall any such sign affect the applicability of any proclamation or portion thereof. Where there is conflict between signs and maps, boundary descriptions shall prevail.

F. This proclamation closes 175 acres in the Lockwoods Folly River area of Brunswick County, 7 acres in the Wrightsville Beach area of New Hanover County, 17 acres in the Topsail Sound area of Pender County, 41 acres in the Mill Creek area of Onslow County, 93 acres in the Queens Creek area of Onslow County, 22 acres in the White Oak River of Carteret County, 3 acres in the Deer Creek area of Carteret County, 158 acres in the Harkers Island area of Carteret County, 694 acres in the Merrimon/South River area of Carteret and Craven Counties, 384 acres in the Oriental area of Pamlico County, 242 acres in the Bay River area of Pamlico County, 114 acres in the Swanquarter area of Hyde County, 130 acres in the Wysocking Bay area of Hyde County, and 370 acres in the Engelhard area of Hyde County. This Proclamation also opens 50 acres in the Stump Sound
