(43) TOPSAIL SOUND AREA (Map 43)

(a) Beckys Creek (Bishop Creek) – All those waters upstream of a straight line beginning at a point 34° 25.6882' N -77° 34.4541' W on the western shore of the creek; running easterly to a point 34° 25.7752' N -77° 34.1746' W on the eastern shore of the creek.

(b) Virginia Creek – All those waters upstream of a straight line beginning at a point 34° 25.1692' N -77° 35.5666' W on the northern shore of the creek; running southwesterly to a point 34° 24.9967' N -77° 35.7280' W on the southern shore of the creek.

(c) Old Topsail Creek – All those waters in Old Topsail Creek upstream of a straight line beginning at a point 34° 21.7853’ N -77° 40.9054’ W on the west shore; running easterly to a point 34° 22.0170’ N -77° 40.5040’ W on the east shore.

(d) Mill Creek – All those waters in Mill Creek upstream of a straight line beginning at a point 34° 20.6523’ N -77° 42.0921’W on the north shore; running southwesterly to a point 34° 20.3922’ N -77° 42.2148’ W; running southwesterly to a point 34° 20.3415’ N -77° 42.2459’ W on the south shore.

(e) Futch Creek –All those waters upstream of a straight line across the mouth of Futch Creek beginning at a point 34° 18.1562' N -77° 44.3210' W on the northern shore of the creek; running southwesterly to a point 34° 17.9722' N -77° 44.5103' W on the southern shore of the creek.

(f) Scotts Hill Marina – All those waters within Scotts Hill Marina and extending beyond the dockage facilities 325 feet beginning at a point 34° 18.7161’ N -77° 43.9107’ W on the north shore; running southeasterly to a point 34° 18.6661’ N -77° 43.8065’ W; running southwesterly to a point 34° 18.5644’ N -77° 43.8799’ W; running northwesterly to a point 34° 18.6030’ N -77° 43.9624’ W on the south shore.

(g) South Beach Yacht Club and Marina and Bush’s Repair Center – All those waters within South Beach Yacht Club and Marina and Bush’s Repair Center and extending beyond the dockage facilities 175 feet beginning at a point 34° 21.9710’ N -77° 37.8431’ W on the shore northeast of the marina; running northwesterly to a point 34° 22.0077’ N -77° 37.8821’ W in the sound; running southwesterly to a point 34° 21.9387’ N -77° 37.9767'’ W in the sound; running southeasterly to a point 34° 21.8971’ N -77° 37.9325’ W on the shore southwest of the marina.

(h) Forest Sound Marina – All those waters within Forest Sound Marina and extending beyond the dockage facilities 275 feet beginning at a point 34° 21.4820’ N -77° 40.8110’ W on the shore north of the marina; running southeasterly to a point 34° 21.4581’ N -77° 40.7756’ W; running southwesterly to a point 34° 21.4023’ N -77° 40.8303’ W; running northwesterly to a point 34° 21.4312’ N -77° 40.8731’ W on the shore south of the marina.

(i) Harbor Village Marina – All those waters within Harbor Village Marina and extending beyond the dockage facilities 600 feet beginning at a point 34° 23.1230’ N -77° 38.1468’ W on the shore northeast of the entrance canal; running southeasterly to a point 34° 23.0749’ N -77° 38.0894’ W; running southwesterly to a point 34° 22.9664’ N -77° 38.2250’ W; running northwesterly to a point 34° 23.0353’ N -77° 38.3072’ W on the shore southwest of the entrance canal.

(j) Queen’s Grant /Briney Canal-All those waters within 400 feet of the last dockage spaces at Briney Canal and Queen’s Grant beginning at a point 34° 22.9387’ N -77° 36.7398’ W on the north shore; running northwesterly to a point 34° 22.9853’ N -77° 36.7883’ W; running southwesterly to a point 34° 22.8918’ N -77° 36.9098’ W; running southeasterly to a point 34° 22.8416’ N -77° 36.8577’ W on the south shore.

(k) R & Q Basin-All those waters within 200 feet of the last dockage space in R & Q basin beginning at a point 34° 22.9362’ N -77° 36.6730’ W on the northeast shore; running southwesterly to a point 34° 22.9240’ N -77° 36.6881’ W on the southwest shore.

(l) Yacht Basin (Doctor’s Basin) -All those waters within 275 feet of the last dockage space in the Yacht Basin (Doctor’s Basin) beginning at a point 34° 22.3459’ N -77° 37.5173’ W on the shore northeast of the basin entrance; running northwesterly to a point 34° 22.3686’ N -77° 37.5422’ W in the sound; running southwesterly to a point 34° 22.3226’ N -77° 37.6034’ W in the sound; running southeasterly to a point 34° 22.3060’ N -77° 37.5853’ W on the shore southwest of the entrance to the basin.

(m)Sloop Point /Channel Marker 90 Seafood Marinas – All those waters extending 100 feet from the Sloop Point Boathouse Marina and Channel Marker 90 Seafood Marina beginning at a point34° 24.3565’ N -77° 36.3835’ W on shore west of the Sloop Point Marina; running southerly to a point34° 24.3219’ N -77° 36.3634’ W; running easterly to a point34° 24.3557’ N -77° 36.2830’ W; running northerly to a point34° 24.3812’ N -77° 36.2976’ W east of the Marker 90 Seafood Marina.

(n) South Topsail Beach Canals –All those waters within the three canals at South Topsail Beach near the inlet and extending beyond the dockage facilities 600 feet beginning at a point 34° 21.0628' N -77° 39.1536' W on the shore southwest of the canal; running northwesterly to a point 34°21.1300' N -77° 39.2319' W in the sound; running northeasterly to a point 34° 21.3157' N -77° 38.9192' W in the sound; running southeasterly to a point 34° 21.2278' N -77° 38.8176' W on the shore northeast of the canals.

(o) Mallard Bay -All those waters in the Mallard Bay/Nixon’s Creek area upstream of a line beginning at a point 34° 23.6787' N -77° 37.4147' W on the mainland; running southeasterly to a point 34° 23.6000' N -77° 37.3285' W on the shore of the IWW; running southwesterly along the shoreline to a point 34° 23.5048' N -77° 37.4790' W at the mouth of the canal; running southwesterly across the mouth of the canal to a point 34° 23.4868' N -77° 37.5216' W ; running southwesterly following the shoreline to a point 34° 23.3628' N -77° 37.7104' W on the shore; running southeasterly approximately 100 yards to a point 34° 23.3295' N -77° 37.6741' W in the Intracoastal Waterway

(IWW); running southwesterly approximately 100 yards to a point 34° 23.3001' N -77° 37.7153' W in the IWW; running northwesterly approximately 50 yards to a point 34° 23.3232' N -77° 37.7398' W on the shore; running southwesterly following the shoreline approximately 700 yards to a point 34° 23.2088' N -77° 37.9051' W on the northern breakwater; running southwesterly across the channel mouth to a point 34° 23.2044' N -77° 37.9145' W on the southern breakwater.
