RE: SHELLFISH POLLUTED AREA
Dr. Louis B. Daniel III, Director, Division of Marine Fisheries, upon the recommendation of Robin Cummings, M.D., Acting State Health Director, Department of Health and Human Services, hereby announces that the following change in shellfish harvesting areas will take effect at sunrise, Saturday, September 7, 2013.
All those waters in Carteret County will return to the status in existence immediately prior to the September 3, 2013, temporary closures except the following which will remain closed:.
Newport River – All those waters in Newport River upstream of a line across the river from Crab Point to the southern end of the west shore of Core Creek.
North River – All those waters upstream of a line across the River beginning at the Oyster House on the west shore; thence in a straight line to the north shore of the mouth of Ward Creek.
Ward Creek - All those waters in Ward Creek upstream of a line beginning at a point on the north shore at 34° 46.2667' N - 76° 35.4933' W, running southerly to a point on the south shore at 34° 45.4517' N - 76° 35.1767' W. (Ward Creek DMF Shrimp Line).
A. This proclamation is issued under the authority of N.C.G.S. 113-170.4; 113-170.5; 113-182; 113-221.1; 143B-289.52 and N.C. Marine Fisheries Commission Rules 15A NCAC 03H . 0103 and 03K .0101.
B. It is unlawful to violate the provisions of any proclamation issued by the N.C. Fisheries Director under his delegated authority pursuant to N.C. Marine Fisheries Commission Rule 15A NCAC 03H .0103.
C. This proclamation returns the following area to normal closure boundaries: A portion of Newport River, a portion of North River, Whitehurst Creek and Sleepy Creek.
D. These reopenings are due to satisfactory bacteriological sampling results.
