PROCLAMATION
RE: SHELLFISH POLLUTED AREA
Dr. Louis B. Daniel III, Director, Division of Marine Fisheries, upon the recommendation of Robin Cummings, M.D., Acting State Health Director, Department of Health and Human Services, hereby announces that the following changes in shellfish harvesting areas will take effect at sunrise, Friday, September 19, 2014.
All those waters in Carteret County will return to the status in existence immediately prior to August 19, September 9, and September 13, 2014, temporary closures, except the following which will remain closed:
CARTERET COUNTY
All those waters bordered on the southwest by a line beginning at a point on the mainland; running southeasterly through FL Beacon “59” following the western shoreline of Shacklefoot Channel to a point on Browns Island; and bordered on the northeast by the Emerald Isle Bridge, to include Bear Creek, Sanders Creek, Cow Channel, Queens Creek, White Oak River, West Channel and Bogue Inlet.
All those waters In Bogue Sound from the Intracoastal Waterway to the mainland between the Emerald Isle Bridge and Beacon “23” near Gales Creek, to include Deer Creek, Hunting Island Bay, Goose Creek, Sanders Creek, and Broad Creek.
Hoop Pole Creek - All those waters in the Hoop Pole Creek area upstream of a line beginning on a point of marsh at 34°42.4519’ N -76°45.1967’ W; running southeasterly across the bay to a point of marsh at 34°42.4429’ N -76°45.1829’ W; running southeasterly following the shoreline to a point at 34°42.4069’ N -76°45.1285’ W; running southeasterly across the creek to a point 34°42.3984’ N -76°45.1098’ W on the eastern shore.
Newport River - All those waters in Newport River upstream of the Highway 70 High Rise Bridge and Morehead-Beaufort Causeway, to include all tributaries and Core Creek.
The following also remains closed:
BRUNSWICK / NEW HANOVER / PENDER / ONSLOW COUNTIES
All those waters between IWW Marker "89" and the South Carolina Line, to include the Tubbs Inlet area.
All those waters in Myrtle Grove Sound within a boundary beginning at a point on the mainland; running easterly through Beacon “141” to the southwestern tip of US Army Corps Disposal Island #261; running southwesterly to the northwestern tip of US Army Corps Disposal Island #267; running northwesterly through Beacon “149” to a point on the mainland.
All those waters in Topsail Sound from the Intracoastal Waterway to the mainland between Beacon “100” near Mill Creek and Beacon “94” near Harbor Village Marina.
All those waters in Stump Sound between Beacon “57” near Old Settlers Canals and Beacon “31” near Turkey Creek.
All those waters bordered on the southwest by a line beginning at a point on the mainland; running southeasterly through FL Beacon “59” following the western shoreline of Shacklefoot Channel to a point on Browns Island; and bordered on the northeast by the Emerald Isle Bridge, to include Bear Creek, Sanders Creek, Cow Channel, Queens Creek, White Oak River, West Channel and Bogue Inlet.
GENERAL INFORMATION:
A. This proclamation is issued under the authority of N.C.G.S. 113-170.4; 113-170.5; 113-182; 113-221.1; 143B-289.52 and N.C. Marine Fisheries Commission Rules 15A NCAC 03H . 0103 and 03K .0101.
B. It is unlawful to violate the provisions of any proclamation issued by the N.C. Fisheries Director under his delegated authority pursuant to N.C. Marine Fisheries Commission Rule 15A NCAC 03H .0103.
C. This proclamation returns the following area to normal closure boundaries: Jarrett Bay
D. This reopening is due to satisfactory bacteriological sampling results.
