PROCLAMATION

RE: SHELLFISH POLLUTED AREA


Dr. Louis B. Daniel III, Director, Division of Marine Fisheries, upon the recommendation of Robin Cummings, M.D., Acting State Health Director, Department of Health and Human Services, hereby announces that the following changes in shellfish harvesting areas will take effect at sunrise, Saturday, September 13, 2014.

All those waters in Onslow and Carteret Counties will return to the status in existence immediately prior to the August 22, September 8, September 9, 2014, temporary closures, except the following which will remain closed:

ONSLOW / CARTERET COUNTIES

All those waters
bordered on the northeast by a straight line from Swan Point through ICWW Channel Marker #4 to the eastern tip of West Onslow Beach, (south shore of New River Inlet), and bordered on the southwest by the Surf City Bridge.

Queens Creek - All those waters in Queens Creek upstream of a straight line across the mouth.

Hoop Pole Creek- All those waters in the Hoop Pole Creek area upstream of a line beginning on a point of marsh at 34°42.4519’ N -76°45.1967’ W; running southeasterly across the bay to a point of marsh at 34°42.4429’ N -76°45.1829’ W; running southeasterly following the shoreline to a point at 34°42.4069’ N -76°45.1285’ W; running southeasterly across the creek to a point 34°42.3984’ N -76°45.1098’ W on the eastern shore.

North River – All those waters in North River upstream of a line beginning on the west shore at a point 34° 46.0383' N - 76° 37.0633' W near Fulcher Bay; running easterly to a point on the north shore of the mouth of Ward Creek at 34° 46.2667' N - 76° 35.4933' W (DMF Special Secondary Nursery Line).

Jarrett Bay and The Straits - All those waters bordered on the east by a line beginning at a point on the east shore of Spit Bay; thence in a straight line to the southern end of Davis Island; thence in a straight line thru Flashing Beacon #36; thence in a straight line to the southeast end of Bells Island; thence in a straight line to the eastern end of Browns Island; thence in a straight line to Shell Point on Harkers Island; and bordered on the west by a line following the Harkers Island Bridge from Harkers Island to the mainland at Straits. This includes Jarrett Bay, Middens Creek, Tusk Creek, Jump Run Creek, Bells Creek, The Straits, Eastmouth Bay, Westmouth Bay, Sleepy Creek, Whitehurst Creek and all creeks and tributaries within the described area.

The following also remains closed:

BRUNSWICK / NEW HANOVER / PENDER COUNTIES


All those waters between IWW marker "84" and the South Carolina State Line, to include the Tubbs Inlet area.

Lockwood Folly River - All those waters north of a line beginning on the west shore at a point 33°55.7954’N - 78°13.3096’ W approximately midway between Genoes Point and Spring Creek; running southeasterly to a point 33°55.2284’N - 78°12.7791’ W near the northwest point of Horse Island, to include the open portion of the atlantic Intracoastal Waterway north of Horse Island.

All those waters between Snows Cut and the Figure Eight Island Bridge, to include Myrtle Grove Sound, Masonboro Sound, and a portion of Middle Sound.

All those waters, from the IWW to the mainland, between the Figure Eight Island Bridge and the Surf City Bridge.

All those waters bordered on the northeast by a straight line from Swan Point through ICWW Channel Marker #4 to the eastern tip of West Onslow Beach, (south shore of New River Inlet), and bordered on the southwest by the Surf City Bridge.

GENERAL INFORMATION:

A. This proclamation is issued under the authority of N.C.G.S. 113-170.4; 113-170.5; 113-182; 113-221.1; 143B-289.52 and N.C. Marine Fisheries Commission Rules 15A NCAC 03H . 0103 and 03K .0101.

B. It is unlawful to violate the provisions of any proclamation issued by the N.C. Fisheries Director under his delegated authority pursuant to N.C. Marine Fisheries Commission Rule 15A NCAC 03H .0103.

C. This proclamation returns the following areas to normal closure boundaries: Salliers Bay, Freeman Creek, Bear Creek, a portion of Bogue Sound, Newport River, a portion of North River, Wards Creek, Oyster Creek, Brett Bay, Nelson Bay, Thorofare Bay, Rumley Bay, and Cedar Island Bay.

D. These reopenings are due to satisfactory bacteriological sampling results.
