PROCLAMATION

RE: SHELLFISH POLLUTED AREA


Stephen W. Murphey, Director, Division of Marine Fisheries, upon the recommendation of Betsey Tilson, M.D., M.P.H., State Health Director, Department of Health and Human Services, hereby announces that the following changes in shellfish harvesting areas will take effect at sunrise, Wednesday, September 11, 2019.

All those waters in Carteret County will return to the status in existence immediately prior to the September 4, 2019, temporary closures except the following which will remain closed:

CARTERET COUNTY

All those waters between the prohibited area closure line at Fort Macon and the South Carolina State Line, to include White Oak River, Bogue Sound, and Tar Landing Bay.

All those waters in Newport River upstream of the Highway 70 High Rise Bridge and the Morehead-Beaufort Causeway, to include all tributaries and Core Creek.

All those waters bounded by a line beginning at a point 34° 54.2203' N -76° 18.8592' W near Hall Point, running southeasterly to Beacon “20”; thence running southwesterly to Beacon “33” in Core Sound; thence running southwesterly to Green Marker “37” off Jarrett Bay; thence running southwesterly to Shell Point on Harkers Island; and bordered in the west by a line beginning at a point along the southwestern tip of Harkers Island at 34° 42.0981' N - 76° 35.0718' W; thence running in a straight line near Channel Marker #56A to the permanent closure line near Channel Marker #56B, to include all of North River, the North River Marshes, The Straits, Eastmouth Bay, Westmouth Bay, Whitehurst Creek, Sleepy Creek, Jarrett Bay, Oyster Creek, Brett Bay, Nelson Bay, a portion of Core Sound, and all creeks and tributaries within the described area.

All those waters west of a line beginning at Camp Point near Cedar Island, running southerly to Hog Island Point; thence running southwesterly to Long Point, thence running southerly to a point 34° 54.2203' N -76° 18.8592' W near Hall Point in Atlantic, to include Thorofare Bay, Rumley Bay, Cedar Island Bay, and Back Bay.

All those waters
north and west of a line beginning at the Cedar Island Ferry Terminal, running southeasterly along the shore of Cedar Island to Camp Point; thence running southeasterly near Wainwright Island to a point on Core Banks at 34° 59.0185' N - 76° 09.9344' W, to include Neuse River, Pamlico Sound, Long Bay, West Bay, West Thorofare Bay, and North Bay.

The following also remains closed:

BRUNSWICK / NEW HANOVER / PENDER / ONSLOW / CRAVEN / PAMLICO / BEAUFORT / HYDE / DARE COUNTIES

All those waters between the prohibited area closure line at Fort Macon and the South Carolina State Line, to include Tubbs Inlet, Shallotte River, Lockwoods Folly River, Cape Fear River, Myrtle Grove Sound, Masonboro Sound, Topsail Sound, Stump Sound, Chadwick Bay, New River, Salliers Bay, Freeman Creek, Bear Creek, Queens Creek, White Oak River, Bogue Sound, and all other creeks and tributaries within said boundaries.

All those waters
north and west of a line beginning at the Cedar Island Ferry Terminal, running southeasterly along the shore of Cedar Island to Camp Point; thence running southeasterly near Wainwright Island to a point on Core Banks at 34° 59.0185' N - 76° 09.9344' W, to include Neuse River, Bay River, Pamlico Sound, Pamlico River, Pungo River, Rose Bay, Swanquarter Bay, Juniper Bay, Wysocking Bay, Long Shoal River, Stumpy Point Bay, Croatan Sound, and Roanoke Sound.

GENERAL INFORMATION:

A. This proclamation is issued under the authority of N.C.G.S. 113-170.4; 113-170.5; 113-182; 113-221.1; 143B-289.52 and N.C. Marine Fisheries Commission Rules 15A NCAC 03H .0103 and 03K .0101.

B. It is unlawful to violate the provisions of any proclamation issued by the N.C. Fisheries Director under his delegated authority pursuant to N.C. Marine Fisheries Commission Rule 15A NCAC 03H .0103.

C. In accordance with N.C. General Statute 113-221.1(c) all persons who may be affected by proclamations issued by the Fisheries Director are under a duty to keep themselves informed of current proclamations.

D. This proclamation returns the following areas to normal closure boundaries: a portion of Core Sound and Back Sound.

E. These reopenings are due to satisfactory bacteriological sampling results.
