PROCLAMATION

RE: SHELLFISH POLLUTED AREA


Dr. Louis B. Daniel III, Director, Division of Marine Fisheries, upon the recommendation of Robin Cummings, M.D., Acting State Health Director, Department of Health and Human Services, hereby announces that the following changes in shellfish harvesting areas will take effect at sunrise, Thursday, August 28, 2014.

All those waters in Pender, Onslow, and Carteret Counties will return to the status in existence immediately prior to the August 1, August 2, August 4, August 19 and August 24, 2014, temporary closures, except the following which will remain closed:

CARTERET COUNTY

Bogue Sound – All those waters from the IWW to the mainland between IWW Beacon “27” and IWW Beacon “20”, to include all of Broad Creek and Gales Creek.

Bogue Sound - All those waters in Bogue Sound 300 yards offshore of Pine Knoll Shores between a point 34° 42.2346’ N -76° 47.7094’ W on the western shore of Bogue Pines Boat Basin, and a point 34° 42.1983’ N -76° 46.6539’ W on the shore near the intersection of Lee Drive and Forest Knoll Drive, to include the shoreline of the Crystal Coast Country Club Golf Course.

Hoop Pole Creek - All those waters in the Hoop Pole Creek area upstream of a line beginning on a point of marsh at 34°42.4519’ N -76°45.1967’ W; running southeasterly across the bay to a point of marsh at 34°42.4429’ N -76°45.1829’ W; running southeasterly following the shoreline to a point at 34°42.4069’ N -76°45.1285’ W; running southeasterly across the creek to a point 34°42.3984’ N -76°45.1098’ W on the eastern shore.

Newport River - All those waters upstream of a line beginning at a point on the south shore at 34° 45.7044' N -76° 43.4977' W near Penn Point; running northerly to a point on the west shore of Harlowe Creek at 34° 46.6935' N -76° 43.4719' W.

North River – All those waters in North River upstream of a line beginning on the west shore at a point 34° 46.0383' N - 76° 37.0633' W near Fulcher Bay; running easterly to a point on the north shore of the mouth of Ward Creek at 34° 46.2667' N - 76° 35.4933' W (DMF Special Secondary Nursery Line).

The following also remains closed:

BRUNSWICK COUNTY

All those waters between IWW Marker "84" and the South Carolina Line, to include the Tubbs Inlet area.

All those waters upstream of a straight line beginning at a point 33° 55.3874’ N – 78° 22.2861’ W on the western shore of the Shallotte River approximately 650 yards south of The Swash; running southeasterly to a point 33° 55.3385’ N – 78° 21.7279’ W on the eastern shore of the Shallotte River approximately 650 yards south of Shallotte Creek.

All those waters between Fl. Beacon “51A” and Southport, to include Lockwoods Folly River.

GENERAL INFORMATION:

A. This proclamation is issued under the authority of N.C.G.S. 113-170.4; 113-170.5; 113-182; 113-221.1; 143B-289.52 and N.C. Marine Fisheries Commission Rules 15A NCAC 03H . 0103 and 03K .0101.

B. It is unlawful to violate the provisions of any proclamation issued by the N.C. Fisheries Director under his delegated authority pursuant to N.C. Marine Fisheries Commission Rule 15A NCAC 03H .0103.

C. This proclamation returns the following areas to normal closure boundaries: Topsail Sound, Stump Sound, and Hunting Island Bay area.

D. These reopenings are due to satisfactory bacteriological sampling results.
