PROCLAMATION

RE: SHELLFISH POLLUTED AREA


Dr. Louis B. Daniel III, Director, Division of Marine Fisheries, upon the recommendation of Robin Cummings, M.D., Acting State Health Director, Department of Health and Human Services, hereby announces that the following shellfish area temporary closures will take effect immediately:

No person shall take or attempt to take any oysters, clams or mussels or possess, sell or offer for sale any oysters, clams or mussels taken from the following polluted area:

BRUNSWICK / PENDER / ONSLOW COUNTIES

All those waters between IWW Marker "84" and the South Carolina Line, to include the Tubbs Inlet area.

All those waters between Fl. Beacon “51A” and Southport, to include Lockwoods Folly River.

All those waters bordered on the southwest by a line beginning on the shoreline near Old Point (Old Topsail Creek) through Fl Beacon “98” to a the southwestern tip of Topsail Beach, and all those waters bordered on the northeast by a straight line from Swan Point through ICWW Channel Marker #4 to the eastern tip of West Onslow Beach, (south shore of New River Inlet), to include Virginia Creek, Stump Sound, Chadwick Bay, and Alligator Bay.

The following also remains closed:

BRUNSWICK / NEW HANOVER / CARTERET COUNTIES

All those waters upstream of a straight line beginning at a point 33° 55.3874’ N – 78° 22.2861’ W on the western shore of the Shallotte River approximately 650 yards south of The Swash; running southeasterly to a point 33° 55.3385’ N – 78° 21.7279’ W on the eastern shore of the Shallotte River approximately 650 yards south of Shallotte Creek.

All those waters within a boundary beginning at a point on the mainland; running easterly through Beacon “141” to the southwestern tip of US Army Corps Disposal Island #261; running southwesterly to the northwestern tip of US Army Corps Disposal Island #267; running northwesterly through Beacon “149” to a point on the mainland.

All those waters from the Intracoastal Waterway to the mainland from the Figure 8 Island Bridge to the permanent closure line at Wrightsville Beach.

Bogue Sound - All those waters from the Intracoastal Waterway to the mainland between Channel Marker #40 and Channel Marker #42, to include all of Hunting Island Bay.

Bogue Sound – All those waters bordered on the west by a straight line from a point on the mainland near the end of Blue Heron Dr., running southeasterly through Channel Marker #30, thence to a point on Bogue Banks near the end of 23rd St. in Emerald Isle, and bordered on the east by the permanent prohibited area closure line at Fort Macon to include Tar Landing Bay.

Newport River - All those waters in Newport River upstream of the Highway 70 High Rise Bridge and Morehead-Beaufort Causeway, to include all tributaries and Core Creek.

North River - All those waters in North River upstream of a straight line beginning at a point at the permanent closure line near Channel Marker #56B to the mainland side of the Harker's Island Bridge at the Straits.

Sleepy Creek - All those waters in Sleepy Creek upstream of a straight line across the mouth.

GENERAL INFORMATION:

A. This proclamation is issued under the authority of N.C.G.S. 113-170.4; 113-170.5; 113-182; 113-221.1; 143B-289.52 and N.C. Marine Fisheries Commission Rules 15A NCAC 03H . 0103 and 03K .0101.

B. It is unlawful to violate the provisions of any proclamation issued by the N.C. Fisheries Director under his delegated authority pursuant to N.C. Marine Fisheries Commission Rule 15A NCAC 03H .0103.

C. This temporary closure is due to heavy rainfall and resultant runoff.
