PROCLAMATION

RE: SHELLFISH POLLUTED AREA

Dr. Louis B. Daniel III, Director, Division of Marine Fisheries, upon the recommendation of Laura Gerald, M.D., M.P.H., State Health Director, Department of Health and Human Services, hereby announces that the following shellfish area changes and closure will take effect at immediately:

No person shall take or attempt to take any oysters, clams or mussels or possess, sell or offer for sale any oysters, clams or mussels taken from the following polluted areas:

The following change is an additional closure to shellfish harvesting and the new closure description is as follows:

ONSLOW COUNTY

SNEADS FERRY AREA (C-2) – Map 39

c) Courthouse Bay Marina - All those waters within 150 feet of the dockage at Courthouse Bay Marina beginning at a point on shore 34º 34.9997'N -77º 22.3785'W northwest of the marina; running northeasterly to a point 34º 35.0477'N -77º 22.2950'W in the bay; running southeasterly to a point 34º 34.9908'N -77º 22.2397'W in the bay; running southwesterly to a point 34º 34.9588'N -77º 22.2878'W on the shore southeast of the marina.

The following changes are technical revisions to closure description text and maps and do not result in any additional closures:

LOCKWOODS FOLLY RIVER AREA (A-3) – Map 48

f) All those waters bounded on the north and east by a line beginning on Federal Point at 33° 57.6326’ N -77° 56.5399’ W; running northwesterly to a point at 33° 57.6858’ N -77° 56.7862’ W; running southwesterly to a point near Beacon “26” at 33° 57.5325’ N -77° 57.2171’ W; running southwesterly to a point near Beacon “23” at 33° 56.2080’ N -77° 58.7519’ W; running southwesterly to a point 33º 54.6110' N -78º 01.1093' W in the river; running southerly near Beacon “16” to a point on Fort Caswell at 33° 53.7710’ N -78° 00.9928’ W to include all waters in Elizabeth River, Dutchman Creek, Intracoastal Waterway and all tributaries; and bounded on the west by a line beginning at a point 33° 55.2631’ N -78° 12.2881’ W on the north shore; running southerly to a point 33° 55.1839’ N -78° 12.2839’ W on the south shore.

MOREHEAD CITY AREA (E-3) – Map 31

(d) Atlantic Beach Area - Money Island Bay Area – All those waters south and west of a line beginning at a point 34 ° 42.6627’ N -76 ° 44.1884’ W on the south end of the Atlantic Beach High Rise Bridge; running southeasterly to a point 34 ° 42.1489’ N -76 ° 43.2623’ W on the eastern end of Money Island Bay near 8 ½ Marina. This includes all of Money Island Bay, Causeway Canal, West Canal. Central Canal, East Canal, Money Island Slough, Anchorage Marina and 8½ Marina.
 
(e) Atlantic Beach Area - Moonlight Bay Area -All those waters upstream of a line beginning at a point 34 ° 42.7229’ N -76 ° 44.4793’ W on the west shore; running easterly to a point 34 ° 42.6804’ N -76 ° 44.2282’ W on the west side of the south end of the Atlantic Beach High Rise Bridge.

(f) Atlantic Beach Area - Fish-N-Lake / Pond Drive Area – All those waters upstream of a line beginning at a point on marsh at 34º 42.6670' N -76º 44.8422' W; running easterly across the mouth of the canal to a point 34º 42.6791' N -76º 44.7440' W on the east shore; to include all waters in Fish-N-Lake.

GENERAL INFORMATION:

A. This proclamation is issued under the authority of N.C.G.S. 113-170.4; 113-170.5; 113-182; 113-221.1; 143B-289.52 and N.C. Marine Fisheries Commission Rules 15A NCAC 03H . 0103 and 03K .0101.

B. It is unlawful to violate the provisions of any proclamation issued by the N.C. Fisheries Director under his delegated authority pursuant to N.C. Marine Fisheries Commission Rule 15A NCAC 03H .0103.

C. This amends N.C. Marine Fisheries Proclamation PA-18-2009, (39) (c) and Map 39 and closes approximately 2 acres and; N.C. Marine Fisheries Proclamation PA-62-2008, (48) (f) and Map 48 and does not result in any additional openings or closures, and; N.C. Marine Fisheries Proclamation PA-62-2008 , 31 (d), 31 (e), 31(f) and Map 31 and does not result in any additional openings or closures.

D. This closure is due to a recent Sanitary Survey in the Sneads Ferry area of Onslow County.
