PROCLAMATION

RE: SHELLFISH POLLUTED AREA

Dr. Louis B. Daniel III, Director, Division of Marine Fisheries, upon the recommendation of Laura Gerald, M.D., M.P.H., State Health Director, Department of Health and Human Services, hereby announces that the following changes in shellfish harvesting areas will take effect at sunrise, September 27, 2012.

The new closure descriptions for the Shallotte River, Deer Creek, and Bay River areas are as follows:

No person shall take or attempt to take any oysters, clams or mussels or possess, sell or offer for sale any oysters, clams or mussels taken from the following polluted areas:

BRUNSWICK / CARTERET / PAMLICO COUNTIES

SHALLOTTE RIVER AREA (A-2) - MAP 49

b) Intracoastal Waterway Area – All those waters bordered on the west by a straight line beginning at a point 33º 55.0116'N -78º 18.2718'W on the northern shore of the IWW; running southerly to a point 33º 54.9287'N -78º 18.2735'W on the southern shore of the IWW; and bordered on the east by a straight line beginning at a point 33º 55.0167'N -78º 17.4158'W on the northern shore of the IWW; running southerly to a point 33º 54.9069'N -78º 17.4167'W on the southern shore of the IWW; to include the canals near Greensboro Street on Holden Beach, and Sea Air Boat Basin.

j) All those waters upstream of a line beginning at a point 33° 54.8914’ N -78° 18.4305’ W on the west shore; running easterly to a point 33° 54.8948’ N -78° 18.4099’ W on the east shore.

DEER CREEK AREA (D-4) - MAP 34

 c) Island Harbor Marina - All those waters within Island Harbor Marina and extending beyond the dockage facilities 200 feet beginning at a point 34º 40.1101'N -77º 02.8218'W on the shore west of the marina; running northerly to a point 34º 40.1881'N -77º 02.8488'W in the sound; running easterly to a point 34º 40.2315'N -77º 02.6659'W in the sound; running southerly to a point 34º 40.1603'N -77º 02.6412'W on the shore east of the marina. 

BAY RIVER AREA (F-6) - MAP 19

h) Jones Bay - All those waters of Jones Bay and the IWW bounded on the south and east by a straight line beginning at a point 35º 14.3951'N -76º 35.4245'W on the western shore of the IWW; running northeasterly to a point 35º 14.4884'N -76º 35.3579'W on the eastern shore of the IWW, and; bounded on the north by a straight line beginning at a point 35° 14.7346' N -76° 35.5117' W on the western shore of the IWW; running easterly to a point 35° 14.7465' N -76° 35.4669' W on the eastern shore of the IWW near the footings of the old bridge.

GENERAL INFORMATION:

A. This proclamation is issued under the authority of N.C.G.S. 113-170.4; 113-170.5; 113-182; 113-221.1; 143B-289.52 and N.C. Marine Fisheries Commission Rules 15A NCAC 03H . 0103 and 03K .0101.

B. It is unlawful to violate the provisions of any proclamation issued by the N.C. Fisheries Director under his delegated authority pursuant to N.C. Marine Fisheries Commission Rule 15A NCAC 03H .0103.

C. This amends N.C. Marine Fisheries Proclamation PA-6-2012, (49) (b), Map 49 and by the addition of (49) (j) opens approximately 26 acres, and; N.C. Marine Fisheries Proclamation PA-88-2010, (34) (c) and Map 34 and opens approximately 2 acres, and; N.C. Marine Fisheries Proclamation PA-88-2010, (19) (h) and Map 19 and opens approximately 13 acres.

D. These openings are due to recent Sanitary Surveys in the Shallotte River area of Brunswick County, Deer Creek area of Carteret County, and the Bay River area of Pamlico County.
