PROCLAMATION
RE: SHELLFISH POLLUTED AREA
Dr. Louis B. Daniel III, Director, Division of Marine Fisheries, upon the recommendation of Laura Gerald, M.D., M.P.H., State Health Director, Department of Health and Human Services, hereby announces that the following change in shellfish harvesting areas will take effect at sunrise, Saturday, September 22, 2012:
All those waters in Brunswick County that were temporarily closed will return to the status in existence immediately prior to the September 15, 2012, temporary closure.
The following remains closed:
PENDER / ONSLOW / CARTERET COUNTIES
All those waters bordered on the northeast by a straight line from Swan Point through ICWW Channel Marker #4 to the eastern tip of West Onslow Beach, (south shore of New River Inlet), and bordered on the southwest by the Surf City Bridge.
Newport River - All those waters in Newport River within a boundary beginning at Crab Point 34º 44.8242' N -76º 42.1718' W; running easterly to IWW Beacon “32”; running southwesterly to IWW Beacon “34”; running southwesterly to IWW Beacon “36”; running southerly across the IWW to a point 34º 43.7680' N -76º 41.3084' W at the southern tip of Phillips Island, to include Crab Point Thorofare and a portion of the Newport River Marshes.
GENERAL INFORMATION:
A. This proclamation is issued under the authority of N.C.G.S. 113-170.4; 113-170.5; 113-182; 113-221.1; 143B-289.52 and N.C. Marine Fisheries Commission Rules 15A NCAC 03H . 0103 and 03K .0101.
B. It is unlawful to violate the provisions of any proclamation issued by the N.C. Fisheries Director under his delegated authority pursuant to N.C. Marine Fisheries Commission Rule 15A NCAC 03H .0103.
C. This proclamation returns the following areas to normal closure boundaries: Shallotte River.
D. This reopening is due to satisfactory bacteriological sampling results.
