PROCLAMATION

RE: SHELLFISH POLLUTED AREA


Dr. Louis B. Daniel III, Director, Division of Marine Fisheries, upon the recommendation of Robin Cummings, M.D., Acting State Health Director, Department of Health and Human Services, hereby announces that the following changes in shellfish harvesting areas will take effect at sunrise, Sunday, August 16, 2015.

All those waters in Carteret County will return to the status in existence immediately prior to the August 9 and August 12, 2015, temporary closures except the following which will remain closed:

CARTERET COUNTY

Oyster Creek - All those waters in Oyster Creek upstream of the Hwy 70 Bridge.

All those waters in Nelson Bay north and west of a line beginning at Mill Point in Sea Level, thence in a straight line to Piney Point near Brett Bay.

The following also remains closed:

BRUNSWICK / PENDER / ONSLOW COUNTIES

All those waters between IWW marker "89" and the South Carolina State Line, to include the Tubbs Inlet area.

Shallotte River - All those waters in Shallotte River upstream of a straight line from Bowen Point to Long Point.

Lockwoods Folly River - All those waters north of a line beginning on the west shore at a point 33°55.7954’N - 78°13.3096’ W approximately midway between Genoes Point and Spring Creek; running southeasterly to a point 33°55.2284’N - 78°12.7791’ W near the northwest point of Horse Island, to include the open portion of the Atlantic Intracoastal Waterway north of Horse Island.

All those waters from the IWW to the mainland, between Beacon “98A”, near Howard Landing, and the Surf City Bridge, to include Old Topsail Creek, Virginia Creek, and all other creeks and tributaries within said boundaries.

All those waters bordered on the southwest by the Surf City Bridge, and bordered on the northeast by the North Topsail Beach High-rise Bridge, to include Stump Sound.

Freeman Creek - All those waters in Freeman Creek upstream of a straight line across the mouth.

Bear Creek - All those waters in Bear Creek upstream of a straight line across the mouth.

Queens Creek - All those waters in Queens Creek upstream of a straight line across the mouth.

GENERAL INFORMATION:

A. This proclamation is issued under the authority of N.C.G.S. 113-170.4; 113-170.5; 113-182; 113-221.1; 143B-289.52 and N.C. Marine Fisheries Commission Rules 15A NCAC 03H . 0103 and 03K .0101.

B. It is unlawful to violate the provisions of any proclamation issued by the N.C. Fisheries Director under his delegated authority pursuant to N.C. Marine Fisheries Commission Rule 15A NCAC 03H .0103.

C. This proclamation returns the following areas to normal closure boundaries: Newport River, North River, Ward Creek, Brett Bay, and a portion of Core Sound.

D. This reopening is due to satisfactory bacteriological sampling results.
