PROCLAMATION

RE: SHELLFISH POLLUTED AREA


Dr. Louis B. Daniel III, Director, Division of Marine Fisheries, upon the recommendation of Robin Cummings, M.D., Acting State Health Director, Department of Health and Human Services, hereby announces that the following changes in shellfish harvesting areas will take effect at sunrise, Thursday, August 14, 2014.

All those waters in Brunswick and Carteret Counties will return to the status in existence immediately prior to the July 22, July 25, August 2, and August 4, 2014, temporary closures, except the following which will remain closed:

BRUNSWICK / CARTERET COUNTIES

All those waters between IWW Marker "89" and the South Carolina Line, to include the Tubbs Inlet area.

All those waters upstream of a straight line beginning at a point 33° 55.3874’ N – 78° 22.2861’ W on the western shore of the Shallotte River approximately 650 yards south of The Swash; running southeasterly to a point 33° 55.3385’ N – 78° 21.7279’ W on the eastern shore of the Shallotte River approximately 650 yards south of Shallotte Creek (see map).

All those waters in the IWW between Beacon "71" near Shallotte River, and Fl. Beacon "48A" near Lockwoods Folly Inlet.

Hoop Pole Creek - All those waters in the Hoop Pole Creek area upstream of a line beginning on a point of marsh at 34°42.4519’ N -76°45.1967’ W; running southeasterly across the bay to a point of marsh at 34°42.4429’ N -76°45.1829’ W; running southeasterly following the shoreline to a point at 34°42.4069’ N -76°45.1285’ W; running southeasterly across the creek to a point 34°42.3984’ N -76°45.1098’ W on the eastern shore.

Newport River - All those waters in Newport River upstream of the Highway 70 High Rise Bridge and Morehead-Beaufort Causeway, to include all tributaries and Core Creek.

North River - All those waters in North River upstream of the North River Bridge.

Jarrett Bay – All those waters in Jarrett Bay upstream of a line beginning at a point on the east shore of Spit Bay; thence in a straight line to the northern tip of Davis Island; then in a straight line to the "Chimney" near Jump Run Creek.

Oyster Creek - All those waters in Oyster Creek upstream of a straight line across the mouth.

The following also remains closed:

NEW HANOVER / PENDER / ONSLOW COUNTIES

All those waters bordered on the northeast by a straight line from Swan Point through ICWW Channel Marker #4 to the eastern tip of West Onslow Beach, (south shore of New River Inlet), and bordered on the southwest by Snows Cut.

All those waters bordered on the southwest by a line through IWW Beacon #65A near Salliers Bay and bordered on the northeast by a line beginning at a point on the mainland; running southeasterly through FL Beacon “59”; running southeasterly following the western shoreline of Shacklefoot Channel to a point on Browns Island, to include Salliers Bay and Freeman Creek.

GENERAL INFORMATION:

A. This proclamation is issued under the authority of N.C.G.S. 113-170.4; 113-170.5; 113-182; 113-221.1; 143B-289.52 and N.C. Marine Fisheries Commission Rules 15A NCAC 03H . 0103 and 03K .0101.

B. It is unlawful to violate the provisions of any proclamation issued by the N.C. Fisheries Director under his delegated authority pursuant to N.C. Marine Fisheries Commission Rule 15A NCAC 03H .0103.

C. This proclamation returns the following area to normal closure boundaries: a portion of Shallotte River, Lockwoods Folly River, a portion of North River, Whitehurst Creek, Sleepy Creek, a portion of Jarrett Bay, Brett Bay, Nelson Bay, Thorofare Bay, Rumley Bay, and Cedar Island Bay.

D. These reopenings are due to satisfactory bacteriological sampling results.
