PROCLAMATION

RE: SHELLFISH POLLUTED AREA


Dr. Louis B. Daniel III, Director, Division of Marine Fisheries, upon the recommendation of Robin Cummings, M.D., Acting State Health Director, Department of Health and Human Services, hereby announces that the following change in shellfish harvesting areas will take effect at sunrise, Wednesday, August 13, 2014.

All those waters in Onslow and Carteret Counties will return to the status in existence immediately prior to the July 22, July 25, August 2, and August 4, 2014, temporary closures, except the following which will remain closed:

ONSLOW / CARTERET COUNTIES

All those waters bordered on the northeast by a straight line from Swan Point through ICWW Channel Marker #4 to the eastern tip of West Onslow Beach, (south shore of New River Inlet), and bordered on the southwest by Snows Cut.

All those waters bordered on the southwest by a line through IWW Beacon #65A near Salliers Bay and bordered on the northeast by a line beginning at a point on the mainland; running southeasterly through FL Beacon “59”; running southeasterly following the western shoreline of Shacklefoot Channel to a point on Browns Island, to include Salliers Bay and Freeman Creek (see map).

Newport River - All those waters in Newport River upstream of the Highway 70 High Rise Bridge and Morehead-Beaufort Causeway, to include all tributaries and Core Creek.

North River - All those waters in North River upstream of a straight line beginning at a point at the permanent closure line near Channel Marker #56B to the mainland side of the Harker's Island Bridge at the Straits.

Whitehurst Creek - All those waters in Whitehurst Creek upstream of a straight line across the mouth.

Sleepy Creek - All those waters in Sleepy Creek upstream of a straight line across the mouth.

Jarrett Bay - All those waters upstream of a line beginning at a point on the east shore of Spit Bay; thence in a straight line to the southern end of Davis Island; thence in a straight line thru Flashing Beacon #36; thence in a straight line to the southeast end of Bells Island; thence in a straight line to a point on the Marshallberg shoreline.

Oyster Creek - All those waters in Oyster Creek upstream of a straight line across the mouth.

Brett Bay – All those waters in Brett Bay upstream of a straight line from Piney Point to King Point.

Nelson Bay - All those waters in Nelson Bay upstream of a line from Drum Point to the northern tip of Fulchers Creek.

All those waters bordered on the east and south by a line beginning at Long Point near Rumley Bay thence in a straight line to Lookout Point on the east shore of Thorofare Bay, thence in a straight line across Thorofare Bay to Hall Point near Atlantic, to include Thorofare Bay and Rumley Bay.

Cedar Island Bay – All those waters in Cedar Island Bay upstream of a straight line beginning at Hog Island Point thence across the bay to Long Point, to include Lewis Creek.

The following also remains closed:

BRUNSWICK / NEW HANOVER / PENDER / CARTERET COUNTIES

All those waters between Southport and the South Carolina State Line.

All those waters bordered on the northeast by a straight line from Swan Point through ICWW Channel Marker #4 to the eastern tip of West Onslow Beach, (south shore of New River Inlet), and bordered on the southwest by Snows Cut.

Hoop Pole Creek - All those waters in the Hoop Pole Creek area upstream of a line beginning on a point of marsh at 34°42.4519’ N -76°45.1967’ W; running southeasterly across the bay to a point of marsh at 34°42.4429’ N -76°45.1829’ W; running southeasterly following the shoreline to a point at 34°42.4069’ N -76°45.1285’ W; running southeasterly across the creek to a point 34°42.3984’ N -76°45.1098’ W on the eastern shore.

GENERAL INFORMATION:

A. This proclamation is issued under the authority of N.C.G.S. 113-170.4; 113-170.5; 113-182; 113-221.1; 143B-289.52 and N.C. Marine Fisheries Commission Rules 15A NCAC 03H . 0103 and 03K .0101.

 

B. It is unlawful to violate the provisions of any proclamation issued by the N.C. Fisheries Director under his delegated authority pursuant to N.C. Marine Fisheries Commission Rule 15A NCAC 03H .0103.

C. This proclamation returns the following area to normal closure boundaries: Bear Creek, Queens Creek, White Oak River, and a portion of Bogue Sound.

D. This reopening is due to satisfactory bacteriological sampling results.
