RE: SHELLFISH POLLUTED AREA
Dr. Louis B. Daniel III, Director, Division of Marine Fisheries, upon the recommendation of Laura Gerald, M.D., M.P.H., State Health Director, Department of Health and Human Services, hereby announces that the following change in shellfish harvesting areas will take effect at sunrise, Wednesday, September 12, 2012:
All those waters in Onslow and Carteret Counties that were temporarily closed will return to the status in existence immediately prior to the September 7, 2012, temporary closures except the following which will remain closed:
All those waters from the IWW to the mainland between Channel Marker #36 and Channel Marker #38 near Goose Creek.
All those waters from the ICWW to mainland between Fl.Beacon 25 & Channel Marker #27 near Broad Creek.
Newport River - All those waters in Newport River within a boundary beginning at Crab Point 34º 44.8242' N -76º 42.1718' W; running easterly to IWW Beacon “32”; running southwesterly to IWW Beacon “34”; running southwesterly to IWW Beacon “36”; running southerly across the IWW to a point 34º 43.7680' N -76º 41.3084' W at the southern tip of Phillips Island, to include Crab Point Thorofare and a portion of the Newport River Marshes (see map).
Newport River - All those waters upstream of a line across the river beginning at a point on the south shore at Lawton Point; thence to a point on the north shore just upstream of Hammock Rock (see map).
A. This proclamation is issued under the authority of N.C.G.S. 113-170.4; 113-170.5; 113-182; 113-221.1; 143B-289.52 and N.C. Marine Fisheries Commission Rules 15A NCAC 03H . 0103 and 03K .0101.
B. It is unlawful to violate the provisions of any proclamation issued by the N.C. Fisheries Director under his delegated authority pursuant to N.C. Marine Fisheries Commission Rule 15A NCAC 03H .0103.
C. This proclamation returns the following areas to normal closure boundaries: All those waters from Swan Point to the North Topsail Beach High-Rise Bride, to include Alligator Bay and Chadwick Bay; White Oak River, a portion of Bogue Sound; and a portion of Newport River.
D. This reopening is due to satisfactory bacteriological sampling results.
