PROCLAMATION
RE: SHELLFISH POLLUTED AREA
Dr. Louis B. Daniel III, Director, Division of Marine Fisheries, upon the recommendation of Robin Cummings, M.D., Acting State Health Director, Department of Health and Human Services, hereby announces that the following change in shellfish harvesting areas will take effect at sunrise, Saturday, August 8, 2015.
All those waters in Onslow and Carteret Counties will return to the status in existence immediately prior to the August 4, 2015, temporary closures except the following which will remain closed:
ONSLOW / CARTERET COUNTIES
All those waters bordered on the northeast by a straight line from Swan Point through IWW Channel Marker #4 to the eastern tip of West Onslow Beach, (south shore of New River Inlet), and bordered on the southwest by the Surf City Bridge.
All those waters in Bogue Sound from the Intracoastal Waterway to the mainland, between IWW Marker "27" and IWW Marker "25" near Broad Creek.
The following also remains closed:
BRUNSWICK / NEW HANOVER / PENDER COUNTIES
All those waters between Southport and the South Carolina State Line.
All those waters bordered on the southwest by the Wrightsville Beach Bridge and bordered on the northeast by a line beginning at a point on the southern tip of Topsail Beach; running northwesterly following the eastern shore of Black Mud Channel to the IWW; running northerly across the IWW near Beacon “98A” to a point on the mainland at Forest Sound Marina, to include Pages Creek, and all other creeks and tributaries within said boundaries.
All those waters bordered on the northeast by a straight line from Swan Point through IWW Channel Marker #4 to the eastern tip of West Onslow Beach, (south shore of New River Inlet), and bordered on the southwest by the Surf City Bridge.
GENERAL INFORMATION:
A. This proclamation is issued under the authority of N.C.G.S. 113-170.4; 113-170.5; 113-182; 113-221.1; 143B-289.52 and N.C. Marine Fisheries Commission Rules 15A NCAC 03H . 0103 and 03K .0101.
B. It is unlawful to violate the provisions of any proclamation issued by the N.C. Fisheries Director under his delegated authority pursuant to N.C. Marine Fisheries Commission Rule 15A NCAC 03H .0103.
C. This proclamation returns the following areas to normal closure boundaries: All the waters between Fl. Beacon “65A” to the Emerald Isle High-rise Bridge, including Bear Creek, Queens Creek, and White Oak River, Bogue Sound, Newport River, North River, Middle Marshes, Whitehurst Creek, Sleepy Creek, Jarrett Bay, and Oyster Creek.
D. These reopenings are due to satisfactory bacteriological sampling results.
