RE: SHELLFISH POLLUTED AREA
Dr. Louis B. Daniel III, Director, Division of Marine Fisheries, upon the recommendation of Laura Gerald, M.D., M.P.H., State Health Director, Department of Health and Human Services, hereby announces that the following change in shellfish harvesting areas will take effect at sunrise, Friday, August 24, 2012:
All those waters in Brunswick County that were temporarily closed will return to the status in existence immediately prior to the August 20, 2012, temporary closures except the following which will remain closed:
Shallotte River - All those waters upstream of a straight line beginning at a point 33° 55.3874’ N – 78° 22.2861’ W on the western shore of the Shallotte River approximately 650 yards south of The Swash; running southeasterly to a point 33° 55.3385’ N – 78° 21.7279’ W on the eastern shore of the Shallotte River approximately 650 yards south of Shallotte Creek (see map).
All those waters in the Intracoastal Waterway near Holden Beach between IWW Beacon #71 and IWW Beacon #47, near Lockwoods Folly Inlet.
THE FOLLOWING REMAINS CLOSED:
PENDER / ONSLOW / CARTERET COUNTIES
All those waters bordered on the northeast by a straight line from Swan Point through ICWW Channel Marker #4 to the eastern tip of West Onslow Beach, (south shore of New River Inlet), and bordered on the southwest by a straight line beginning at a point at the southern tip of Topsail Beach; running northwesterly to a point on the mainland at Forest Sound Marina, to include Old Topsail Creek, Virginia Creek, Stump Sound, Alligator Bay, and Chadwick Bay.
All those waters bordered on the west by the Onslow Beach Bridge and bordered on the east by a line running from the mainland through IWW Fl. Beacon #49 following the western shoreline of West Channel to the eastern tip of Bear Island, to include Freeman Creek, Bear Creek, and Queens Creek.
All those waters in Newport River upstream of a line beginning near Penn Point on the south shore at a point 34° 45.6960' N - 76° 43.5180' W running northeasterly to a point 34° 46.5733' N - 76° 42.6350' W on the north shore near Hardesty Farms subdivision.
Nelson Bay - All those waters in Nelson Bay upstream of a line from Drum Point to the northern tip of Fulchers Creek.
A. This proclamation is issued under the authority of N.C.G.S. 113-170.4; 113-170.5; 113-182; 113-221.1; 143B-289.52 and N.C. Marine Fisheries Rules 15A NCAC 03H . 0103 and 03K .0101.
B. It is unlawful to violate the provisions of any proclamation issued by the N.C. Fisheries Director under his delegated authority pursuant to N.C. Marine Fisheries Rule 15A NCAC 03H .0103.
C. This proclamation returns the following areas to normal closure boundaries: The Tubbs Inlet area, a portion of the Shallotte River, and the Shallotte Inlet area.
D. These reopenings are due to satisfactory bacteriological sampling results.
