PROCLAMATION
RE: SHELLFISH POLLUTED AREA¿¿¿¿¿¿¿¿¿¿¿¿¿¿¿¿¿¿¿¿¿¿¿¿¿¿¿¿¿¿¿¿
Braxton Davis, Director, Division of Marine Fisheries, upon the recommendation of Randall Williams, M.D., State Health Director, Department of Health and Human Services, hereby announces that the following changes in shellfish harvesting areas will take effect at sunrise, Saturday, June 11, 2016.
All those waters in Carteret County will return to the status in existence immediately prior to the June 7, 2016, temporary closures except the following which remain closed:
CARTERET COUNTY
All those waters between the Emerald Isle Bridge and FL. Beacon "65A", located just west of Salliers Bay, near New River Inlet, to include Salliers Bay, Freeman Creek, Bear Creek, Queens Creek, and White Oak River.
Newport River – All those waters in Newport River upstream of the Highway 70 High Rise Bridge and Morehead-Beaufort Causeway, to include all tributaries and Core Creek
North River - All those waters in North River upstream of a straight line beginning at a point at the permanent closure line near Channel Marker #56B to the mainland side of the Harkers Island Bridge at the Straits.
Whitehurst Creek - All those waters in Whitehurst Creek upstream of a straight line across the mouth.
Oyster Creek - All those waters in Oyster Creek upstream of a straight line across the mouth.
Nelson Bay – All those waters in Nelson Bay upstream of a line from Drum Point to the northern tip of Fulchers Creek.
All those waters in Long Bay and West Thorofare Bay south of a line beginning on the west shore at Jacks Bay Point, running easterly to Tump Point on the east shore.
Turnagain Bay - All those waters in Turnagain Bay upstream of a line across the mouth.
South River - All those waters in South River upstream of a line across the mouth.
The following also remains closed:
BRUNSWICK / NEW HANOVER / PENDER / ONSLOW / DARE COUNTIES
All those waters between Southport and the South Carolina State Line.
All those waters, IWW to the mainland, bordered on the northeast by a line beginning at a point on the mainland near Futch Creek at 34° 17.9722' N - 77° 44.5103' W, running southeasterly following Nixon Channel to the northern tip of Figure Eight Island near Rich Inlet and bordered on the southwest by the
permanent closure line at Wrightsville Beach.
All those waters in Topsail Sound bordered on the northeast by a line beginning at Long Point on the mainland, running southerly through IWW Beacon “102” and following Long Point Channel to a point on the barrier island near Old Topsail Inlet, and bordered on the southwest by a line beginning at a point on the mainland near Futch Creek at 34° 17.9722' N - 77° 44.5103' W, running southeasterly following Nixon Channel to the northern tip of Figure Eight Island near Rich Inlet.
All those waters, IWW to the mainland, bordered on the northeast by the Surf City Bridge, and bordered on the southwest by IWW Beacon “102” near Long Point.
All those waters bordered on the northeast by a straight line from Swan Point through IWW Channel Marker #4 to the eastern tip of West Onslow Beach, (south shore of the New River Inlet), and bordered on the southwest by the Surf City Bridge.
All those waters between the Emerald Isle Bridge and FL. Beacon "65A", located just west of Salliers Bay, near New River Inlet, to include Salliers Bay, Freeman Creek, Bear Creek, Queens Creek, and White Oak River.
All those waters in Pamlico Sound within 200 yards of the shoreline between a point 35° 41.0197' N - 75° 29.3142' W near New Inlet (Pea Island Refuge) and the north side of Hatteras Inlet.
GENERAL INFORMATION:
A. This proclamation is issued under the authority of N.C.G.S. 113-170.4; 113-170.5; 113-182; 113-221.1; 143B-289.52 and N.C. Marine Fisheries Commission Rules 15A NCAC 03H. 0103 and 03K .0101.
B. It is unlawful to violate the provisions of any proclamation issued by the N.C. Fisheries Director under his delegated authority pursuant to N.C. Marine Fisheries Commission Rule 15A NCAC 03H .0103.
C. In accordance with N.C. General Statute 113-221.1(c) all persons who may be affected by proclamations issued by the Fisheries Director are under a duty to keep themselves informed of current proclamations.
D. This proclamation returns the following areas to normal closure boundaries: a portion of Bogue Sound, Tar Landing Bay, Sleepy Creek, Jarrett Bay, Brett Bay, Thorofare Bay, Rumley Bay, Cedar Island Bay, North Bay, West Bay, and a portion of Long Bay.
E. These reopenings are due to satisfactory bacteriological sampling results.
