PROCLAMATION

SHELLFISH POLLUTED AREA


Braxton Davis, Director, Division of Marine Fisheries, upon the recommendation of Randall Williams, M.D., State Health Director, Department of Health and Human Services, hereby announces that effective sunrise, Tuesday, June 7, 2016, the leases in New Hanover, Pender, Onslow, Carteret and Hyde Counties that were closed exclusively for relaying purposes WILL REOPEN to the harvest of shellfish with the exception of those affected leases located in waters that are temporarily closed which include:

NEW HANOVER / PENDER / ONSLOW / CARTERET COUNTIES

All those waters in Topsail Sound bordered on the northeast by a line beginning at Long Point on the mainland, running southerly through IWW Beacon “102” and following Long Point Channel to a point on the barrier island near Old Topsail Inlet, and bordered on the southwest by a line beginning at a point on the mainland near Futch Creek at 34° 17.9722' N - 77° 44.5103' W, running southeasterly following Nixon Channel to the northern tip of Figure Eight Island near Rich Inlet.

All those waters, IWW to the mainland, between IWW Beacon "49” near Swansboro and IWW Fl. Beacon "59", to include all of Bear Creek and Queens Creek.

White Oak River - All those waters in White Oak River upstream of the Highway 24 Bridge at Swansboro.

All those waters in Jarrett Bay upstream of a line beginning at a point on the east shore of Spit Bay; thence in a straight line to the northern tip of Davis Island; then in a straight line to the "Chimney" near Jump Run Creek.

Nelson Bay – All those waters in Nelson Bay upstream of a line from Drum Point to the northern tip of Fulchers Creek.

The following also remains closed:


BRUNSWICK / DARE COUNTIES

All those waters between Southport and IWW Marker “89”, to include Lockwoods Folly River and Shallotte River.

All those waters┬┐within 200 yards offshore of Hatteras Island between Big Island near Avon and the north side of Hatteras Inlet.

GENERAL INFORMATION:

A. This proclamation is issued under the authority of N.C.G.S. 113-170.4; 113-170.5; 113-182; 113-221.1; 143B-289.52 and N.C. Marine Fisheries Commission Rules 15A NCAC 03H. 0103 and 03K .0101.

B. It is unlawful to violate the provisions of any proclamation issued by the N.C. Fisheries Director under his delegated authority pursuant to N.C. Marine Fisheries Commission Rule 15A NCAC 03H .0103.

C. In accordance with N.C. General Statute 113-221.1(c) all persons who may be affected by proclamations issued by the Fisheries Director are under a duty to keep themselves informed of current proclamations.

D. These reopenings are due to sufficient time having been elapsed to reduce pathogens that might have been present to acceptable levels.
