PROCLAMATION

RE: SHELLFISH POLLUTED AREA


Dr. Louis B. Daniel III, Director, Division of Marine Fisheries, upon the recommendation of Robin Cummings, M.D., Acting State Health Director, Department of Health and Human Services, hereby announces that the following change in shellfish harvesting areas will take effect at sunrise, Thursday, July 10, 2014.

All those waters in New Hanover, Pender, Onslow and Carteret Counties will return to the status in existence immediately prior to the July 4, 2014, temporary closures except the following which will remain closed:

ONSLOW / CARTERET COUNTIES

Freeman Creek - All those waters in Freeman Creek upstream of a straight line across the mouth.

Bear Creek – All those waters in Bear Creek upstream of a straight line across the mouth.

Newport River - All those waters in Newport River upstream of a straight line beginning at a point on the south shore at 34° 45.6646' N – 76° 44.0603’ W, at Lawton Point; thence to a point on the north shore at 34º 46.5724' N -76º 44.3786' W just upstream of Hammock Rock.

The following also remains closed:

BRUNSWICK / CARTERET COUNTIES

All those waters between Southport and the South Carolina State line.

Bogue Sound – All those waters in Bogue Sound from the Intracoastal Waterway to the mainland, between IWW Marker “27” near Broad Creek, and IWW Marker “24”.

Hoop Pole Creek - All those waters in the Hoop Pole Creek area upstream of a line beginning on a point of marsh at 34°42.4519’ N -76°45.1967’ W; running southeasterly across the bay to a point of marsh at 34°42.4429’ N -76°45.1829’ W; running southeasterly following the shoreline to a point at 34°42.4069’ N -76°45.1285’ W; running southeasterly across the creek to a point 34°42.3984’ N -76°45.1098’ W on the eastern shore.

GENERAL INFORMATION:

A. This proclamation is issued under the authority of N.C.G.S. 113-170.4; 113-170.5; 113-182; 113-221.1; 143B-289.52 and N.C. Marine Fisheries Commission Rules 15A NCAC 03H . 0103 and 03K .0101.

B. It is unlawful to violate the provisions of any proclamation issued by the N.C. Fisheries Director under his delegated authority pursuant to N.C. Marine Fisheries Commission Rule 15A NCAC 03H .0103.

C. This proclamation returns the following areas to normal closure boundaries: All those waters between Swan Point and Snows Cut and a portion of Newport River.

D. These reopenings are due to satisfactory bacteriological sampling results.
