PROCLAMATION
RE: SHELLFISH POLLUTED AREA
Dr. Louis B. Daniel III, Director, Division of Marine Fisheries, upon the recommendation of Robin Cummings, M.D., Acting State Health Director, Department of Health and Human Services, hereby announces that the following change in shellfish harvesting area will take effect at sunrise Saturday, May 16, 2015.
All those waters in Onslow and Carteret Counties will return to the status in existence immediately prior to the May 11, 2015, temporary closure except the following which will remain closed:
ONSLOW / CARTERET COUNTIES
All those waters bordered on the northeast by a straight line from Swan Point through IWW Channel Marker #4 to the eastern tip of West Onslow Beach, (south shore of New River Inlet), and bordered on the southwest by the Surf City Bridge.
New River – All those waters in New River upstream of Marker “33”.
Salliers Bay - All those waters in Salliers Bay upstream of a straight line across the mouth.
All those waters from the Intracoastal Waterway to the mainland between the Onslow Beach Bridge and IWW Beacon “49” at Swansboro, to include Freeman Creek, Bear Creek, and Queens Creek.
White Oak River - All those waters in White Oak River upstream of the Highway 24 Bridge at Swansboro.
Newport River - All those waters in Newport River upstream of the Highway 70 High Rise Bridge and Morehead-Beaufort Causeway, to include all tributaries and Core Creek.
North River - All those waters upstream of a straight line beginning at a point on the northwest shore of Goose Bay thence in a straight line across the river near the old Fl. "Danger" Beacon; thence to a point at 34°44.4581’N - 76°37.3826’ W; on the shore south of Cow Pen Creek to include all of Ward Creek.
All those waters in Jarrett Bay upstream of a line beginning at a point on the east shore of Spit Bay; thence in a straight line to the northern tip of Davis Island; then in a straight line to the "Chimney" near Jump Run Creek.
Oyster Creek - All those waters in Oyster Creek upstream of a straight line across the mouth.
The following also remains closed:
BRUNSWICK / PENDER COUNTIES
All those waters between Southport and the South Carolina State Line.
All those waters bordered on the northeast by a straight line from Swan Point through IWW Channel Marker #4 to the eastern tip of West Onslow Beach, (south shore of New River Inlet), and bordered on the southwest by the Surf City Bridge.
GENERAL INFORMATION:
A. This proclamation is issued under the authority of N.C.G.S. 113-170.4; 113-170.5; 113-182; 113-221.1; 143B-289.52 and N.C. Marine Fisheries Commission Rules 15A NCAC 03H . 0103 and 03K .0101.
B. It is unlawful to violate the provisions of any proclamation issued by the N.C. Fisheries Director under his delegated authority pursuant to N.C. Marine Fisheries Commission Rule 15A NCAC 03H .0103.
C. This proclamation returns the following areas to normal closure boundaries: a portion of those waters between IWW Fl. Beacon “65A”, located just west of Salliers Bay and the Emerald Isle High-rise Bridge; a portion of North River; Whitehurst Creek; Sleepy Creek; a portion of Jarrett Bay; Brett Bay; Nelson Bay; Thorofare Bay; Rumley Bay; and Cedar Island Bay.
D. These reopenings are due to satisfactory bacteriological sampling results.
