PROCLAMATION

RE: SHELLFISH POLLUTED AREA


Braxton Davis, Director, Division of Marine Fisheries, upon the recommendation of Kelly Kimple, M.D., M.P.H., Acting State Health Director, Department of Health and Human Services, hereby announces that the following changes in shellfish harvesting areas will take effect at sunrise, Wednesday, May 3, 2017.

All those waters in New Hanover, Pender, Onslow, and Carteret Counties will return to the status in existence immediately prior to the April 25, 2017, temporary closures except the following which will remain closed:

NEW HANOVER / ONSLOW / CARTERET COUNTIES

All those waters bordered on the south by Snows Cut and bordered on the northeast by a line beginning at a point on the mainland between Whiskey Creek and Hewlett’s Creek; running easterly through IWW Beacon “134” to a point on Masonboro Island at 34° 9.7856’ N -77° 49.8845’ W; to include Myrtle Grove Sound and a portion of Masonboro Sound.

All those waters within 100 yards from the dredge spoils effluent pipe at US Army Corps of Engineers Disposal Area #241, located approximately 250 yards south of Fl Beacon “122” near the Mason Creek and IWW crossing.

Queens Creek - All those waters in Queens Creek upstream of a straight line across the mouth.

White Oak River – All those waters in White Oak River upstream of the Highway 24 Bridge at Swansboro.

The following also remains closed:

BRUNSWICK / PAMLICO / BEAUFORT / HYDE COUNTIES

All those waters between Southport and the South Carolina State Line, to include Tubbs Inlet, Shallotte River, and Lockwoods Folly River.

All those waters north and west of a line beginning at Crab Point on the east shore of Swanquarter Bay, running southwesterly to Maw Point, near the mouth of Bay River, to include Swanquarter Bay, Rose Bay, Germantown Bay, Spencer Bay, Pungo River, Pamlico River, Goose Creek, Oyster Creek (Pamlico County), Mouse Harbor, Big Porpoise Bay, Middle Bay, Jones Bay, and Bay River.

GENERAL INFORMATION:

A. This proclamation is issued under the authority of N.C.G.S. 113-170.4; 113-170.5; 113-182; 113-221.1; 143B-289.52 and N.C. Marine Fisheries Commission Rules 15A NCAC 03H. 0103 and 03K .0101.

B. It is unlawful to violate the provisions of any proclamation issued by the N.C. Fisheries Director under his delegated authority pursuant to N.C. Marine Fisheries Commission Rule 15A NCAC 03H .0103.

C. In accordance with N.C. General Statute 113-221.1(c) all persons who may be affected by proclamations issued by the Fisheries Director are under a duty to keep themselves informed of current proclamations.

D. This proclamation returns the following areas to normal closure boundaries: a portion of Masonboro Sound, Middle Sound, Topsail Sound, Stump Sound, Alligator Bay, Chadwick Bay, New River, Salliers Bay, Freeman Creek, Bear Creek, Bogue Sound, Newport River, and Brett Bay.

E. These reopenings are due to satisfactory bacteriological sampling results.
