PROCLAMATION

RE: SHELLFISH POLLUTED AREA


Braxton Davis, Director, Division of Marine Fisheries, upon the recommendation of Kelly Kimple, M.D., M.P.H., Acting State Health Director, Department of Health and Human Services, hereby announces that the following changes in shellfish harvesting areas will take effect at sunrise, Sunday, April 30, 2017.

All those waters in Carteret County will return to the status in existence immediately prior to the April 25, 2017, temporary closures except the following which will remain closed:

CARTERET COUNTY

All those waters bordered on the northeast by the Emerald Isle High-rise Bridge and bordered on the southwest by Snows Cut, to include White Oak River, Queens Creek, Bear Creek, Freeman Creek, Salliers Bay, New River, Chadwick Bay, Alligator Bay, Stump Sound, Topsail Sound, Middle Sound, Masonboro Sound, and Myrtle Grove Sound.

All those waters, Intracoastal Waterway to the mainland, between IWW Beacon “36”, near Goose Creek, to the Emerald Isle High-rise Bridge, to include Goose Creek, Hunting Island Bay, and Deer Creek.

Newport River - All those waters upstream of a straight line beginning at a point on the south shore near Penn Point; running northerly to a point on the west shore of Harlowe Creek.

Brett Bay – All those waters in Brett Bay upstream of a straight line from Piney Point to King Point.

The following also remains closed:

BRUNSWICK / NEW HANOVER / PENDER / ONSLOW / PAMLICO / BEAUFORT / HYDE COUNTIES

All those waters between Southport and the South Carolina State Line, to include Tubbs Inlet, Shallotte River, and Lockwoods Folly River.

All those waters bordered on the northeast by the Emerald Isle High-rise Bridge and bordered on the southwest by Snows Cut, to include White Oak River, Queens Creek, Bear Creek, Freeman Creek, Salliers Bay, New River, Chadwick Bay, Alligator Bay, Stump Sound, Topsail Sound, Middle Sound, Masonboro Sound, and Myrtle Grove Sound.

All those waters north and west of a line beginning at Crab Point on the east shore of Swanquarter Bay, running southwesterly to Maw Point, near the mouth of Bay River, to include Swanquarter Bay, Rose Bay, Germantown Bay, Spencer Bay, Pungo River, Pamlico River, Goose Creek, Oyster Creek (Pamlico County), Mouse Harbor, Big Porpoise Bay, Middle Bay, Jones Bay, and Bay River.

GENERAL INFORMATION:

A. This proclamation is issued under the authority of N.C.G.S. 113-170.4; 113-170.5; 113-182; 113-221.1; 143B-289.52 and N.C. Marine Fisheries Commission Rules 15A NCAC 03H. 0103 and 03K .0101.

B. It is unlawful to violate the provisions of any proclamation issued by the N.C. Fisheries Director under his delegated authority pursuant to N.C. Marine Fisheries Commission Rule 15A NCAC 03H .0103.

C. In accordance with N.C. General Statute 113-221.1(c) all persons who may be affected by proclamations issued by the Fisheries Director are under a duty to keep themselves informed of current proclamations.

D. This proclamation returns the following areas to normal closure boundaries: A portion of Newport River.

E. This reopening is due to satisfactory bacteriological sampling results.
