RE: SHELLFISH POLLUTED AREA
Dr. Louis B. Daniel III, Director, Division of Marine Fisheries, upon the recommendation of Robin Cummings, M.D., Acting State Health Director, Department of Health and Human Services, hereby announces that the following change in shellfish harvesting area will take effect at sunrise, Thursday, May 1, 2014.
All those waters in Brunswick County will return to the status in existence immediately prior to the April 19, 2014, temporary closures, except the following which will remain closed:
All those waters in the IWW at Holden Beach between Beacon “71”, near Shallotte River, and the permanent closure line near Beacon “63”.
The following also remains closed:
ONSLOW / CARTERET COUNTIES
Bear Creek - All those waters in Bear Creek upstream of a straight line across the mouth.
Queens Creek - All those waters in Queens Creek upstream of a straight line across the mouth.
Hoop Pole Creek - All those waters in the Hoop Pole Creek area upstream of a line beginning on a point of marsh at 34°42.4519’ N -76°45.1967’ W; running southeasterly across the bay to a point of marsh at 34°42.4429’ N -76°45.1829’ W; running southeasterly following the shoreline to a point at 34°42.4069’ N -76°45.1285’ W; running southeasterly across the creek to a point 34°42.3984’ N -76°45.1098’ W on the eastern shore.
A. This proclamation is issued under the authority of N.C.G.S. 113-170.4; 113-170.5; 113-182; 113-221.1; 143B-289.52 and N.C. Marine Fisheries Commission Rules 15A NCAC 03H . 0103 and 03K .0101.
B. It is unlawful to violate the provisions of any proclamation issued by the N.C. Fisheries Director under his delegated authority pursuant to N.C. Marine Fisheries Commission Rule 15A NCAC 03H .0103.
C. This proclamation returns the following areas to normal closure boundaries: Tubbs Inlet area, a portion of Shallotte River area, and Lockwoods Folly River.
D. It should be noted that leases closed on or after April 1, 2014, to allow relaying of shellfish from closed areas remain closed.
E. These reopenings are due to satisfactory bacteriological sampling results.
