PROCLAMATION
RE: SHELLFISH POLLUTED AREA
Dr. Louis B. Daniel III, Director, Division of Marine Fisheries, upon the recommendation of Robin Cummings, M.D., Acting State Health Director, Department of Health and Human Services, hereby announces that the following change in shellfish harvesting areas will take effect at sunrise, Wednesday, April 1, 2015.
The new closure description for the Swansboro area in the White Oak River area is as follows:
No person shall take or attempt to take any oysters, clams or mussels or possess, sell or offer for sale any oysters, clams or mussels taken from the following polluted area.
ONSLOW COUNTY
WHITE OAK RIVER AREA (D-3) - MAP 35
c) Swansboro Area – All those waters bounded by a line beginning at a point 34° 41.4565’ N -77° 07.1166’ W on the west shore of Picketts Bay; running southeasterly to a point at 34° 41.2834’ N -77° 06.7973’ W in White Oak River; running southwesterly to a point at 34º 40.9479’ N -77º 07.1405' W in the Intracoastal Waterway; running northwesterly to a point 34º 40.9840' N -77º 07.3072' W near IWW Beacon “47”; running westerly to a point 34º 40.9846' N -77º 07.5125' W near IWW Beacon “47A”; running southwesterly to a point 34º 40.7230' N -77º 07.9065' W near IWW Beacon “48A”; running southerly to a point 34º 40.3029' N -77º 08.0079' W near IWW Beacon “50”; running northwesterly to a point 34º 40.3668' N -77º 08.0478' W on the shore; to include Foster Creek, Dennis Creek, Hawkins Creek and the Swansboro waterfront area.
GENERAL INFORMATION:
A. This proclamation is issued under the authority of N.C.G.S. 113-170.4; 113-170.5; 113-182; 113-221.1; 143B-289.52 and N.C. Marine Fisheries Commission Rules 15A NCAC 03H . 0103 and 03K .0101.
B. It is unlawful to violate the provisions of any proclamation issued by the N.C. Fisheries Director under his delegated authority pursuant to N.C. Marine Fisheries Commission Rule 15A NCAC 03H .0103.
C. This amends N.C. Marine Fisheries Proclamation PA-PC-2015, (35) (c), Map 35 and opens approximately 400 acres.
D. This opening is due to a recent Sanitary Survey in the White Oak River area of Onslow County.
