PROCLAMATION

RE: SHELLFISH POLLUTED AREA

Dr. Louis B. Daniel III, Director, Division of Marine Fisheries, upon the recommendation of Laura Gerald, M.D., M.P.H., State Health Director, Department of Health and Human Services, hereby announces that the following changes in shellfish harvesting areas will take effect at sunrise, March 19, 2013.

The new closure descriptions for the Jarrett Bay and Engelhard areas are as follows:
No person shall take or attempt to take any oysters, clams or mussels or possess, sell or offer for sale any oysters, clams or mussels taken from the following polluted areas:

CARTERET / HYDE / DARE COUNTIES

CORE SOUND – JARRET BAY AREA (E-8) - MAP 26

c) Williston Creek – All those waters in Williston Creek upstream of a straight line beginning at a point 34º 47.2271' N -76º 30.0651' W on the north shore; running southwesterly to a point 34º 47.0243' N -76º 30.3222' W on the south shore.

ENGELHARD AREA (G-5) - MAP 11

a) Far Creek / Waupopin Creek - All those waters upstream of a line beginning at a point 35º 31.1066' N -75º 58.0990' W on the north shore of Waupopin Creek; running southwesterly to a point 35º 30.9065' N -75º 58.4687' W on the south shore of Waupopin Creek; running southeasterly to a point 35º 30.4028' N -75º 58.3228' W on the south shore of Far Creek.

g) Long Shoal River - All those waters in Long Shoal River upstream of a straight line beginning at a point 35º 38.0121' N -75º 52.9120' W on the north shore; running southerly to a point 35º 37.7430' N -75º 52.9664' W on the south shore.

l) Deep Creek (Long Shoal River) - All those waters in Deep Creek upstream of a straight line beginning at a point 35º 37.9086' N -75º 52.2372' W on the north shore; running southerly to a point 35º 37.6667' N -75º 52.2984' W on the south shore.

GENERAL INFORMATION:

A. This proclamation is issued under the authority of N.C.G.S. 113-170.4; 113-170.5; 113-182; 113-221.1; 143B-289.52 and N.C. Marine Fisheries Commission Rules 15A NCAC 03H . 0103 and 03K .0101.

B. It is unlawful to violate the provisions of any proclamation issued by the N.C. Fisheries Director under his delegated authority pursuant to N.C. Marine Fisheries Commission Rule 15A NCAC 03H .0103.

C. This amends N.C. Marine Fisheries Proclamation PA-PC-2006, (26) (c), Map 26 and opens approximately 18 acres, and; N.C. Marine Fisheries Proclamation PA-PC-2006, (11) (a) and Map 11 and opens approximately 370 acres, and; N.C. Marine Fisheries Proclamation PA-90-2010, (11) (g) and Map 11 and by the addition of (11) (l) opens approximately 162 acres.

D. These openings are due to recent Sanitary Surveys in the Jarrett Bay area of Carteret County, and the Engelhard area of Hyde and Dare Counties.
