RE: SHELLFISH POLLUTED AREA
Dr. Louis B. Daniel III, Director, Division of Marine Fisheries, upon the recommendation of Laura Gerald, M.D., M.P.H., State Health Director, Department of Health and Human Services, hereby announces that the following shellfish area changes and closures will take effect immediately:
No person shall take or attempt to take any oysters, clams or mussels or possess, sell or offer for sale any oysters, clams or mussels taken from the following polluted areas:
The following changes are additional closures to shellfish harvesting and the new closure descriptions are as follows:
CARTERET / DARE COUNTIES
NORTH RIVER AND HARKERS ISLAND AREA (E-6 and E-7) – Map 27
s) Brown’s Island - All those waters within a boundary beginning at a point 34º 42.4529' N -76º 32.7676' W on the western shore of Brown’s Island; running southerly, then easterly and northeasterly following the shoreline across all creek mouths to a point 34º 42.1637' N -76º 31.2370' W on the eastern shore of Brown’s Island; to include all the marshes and waters of southern Brown’s Island.
CORE CREEK/MERRIMON – SOUTH RIVER AREA (F-2) – Map 22
h) Jonaquin Creek - All those waters in Jonaquin Creek upstream of a straight line beginning at a point 34º 56.2764' N -76º 38.2712' W on the north shore; running southeasterly to a point 34º 56.1915' N -76º 38.2183' W on the south shore.
HATTERAS – OUTER BANKS AREA (H-4) – Map 8
g) Scotch Bonnet and Windhaven Shores Canals Area - All those waters within a boundary beginning at a point 35º 15.3190' N -75º 36.0625' W on the shore north of Windhaven Shores Canal; running northwesterly to a point 35º 15.3426' N -75º 36.0791' W approximately 50 yards in the sound; running southwesterly to a point 35º 15.2691' N -75º 36.2347' W in the sound approximately 50 yards offshore; running southeasterly to a point 35º 15.2477' N -75º 36.2196' W on the shore south of Scotch Bonnet Canal.
A. This proclamation is issued under the authority of N.C.G.S. 113-170.4; 113-170.5; 113-182; 113-221.1; 143B-289.52 and N.C. Marine Fisheries Commission Rules 15A NCAC 03H . 0103 and 03K .0101.
B. It is unlawful to violate the provisions of any proclamation issued by the N.C. Fisheries Director under his delegated authority pursuant to N.C. Marine Fisheries Commission Rule 15A NCAC 03H .0103.
C. This amends N.C. Marine Fisheries Proclamation PA-PC-2006, and Map 27 by the addition of (27) (s) and closes approximately 283 acres, and; N.C. Marine Fisheries Proclamation PA-PC-2006, and Map 22 by the addition of (22) (h) and closes approximately 79 acres, and; N.C. Marine Fisheries Proclamation PA-PC-2006, and Map 8 by the addition of (8) (g) and closes approximately 3 acres.
D. These closures are due to recent Sanitary Surveys in the Harkers Island and Adams Creek areas of Carteret County, and the Hatteras area of Dare County.
