PROCLAMATION

RE: SHELLFISH POLLUTED AREA


Dr. Louis B. Daniel III, Director, Division of Marine Fisheries, upon the recommendation of Megan Davies, M.D., Acting State Health Director, Department of Health and Human Services, hereby announces that the following changes in shellfish harvesting areas will take effect at sunrise Saturday, February 20, 2016.

All those waters in Pender and Onslow Counties will return to the status in existence immediately prior to the February 4, and February 5, 2016, temporary closures except the following which will remain closed:

PENDER / ONSLOW COUNTIES

All those waters between the North Topsail Beach High Rise Bridge and a line beginning at a point on the mainland near Sloop Point running southwesterly through IWW Beacon “86” and Fl. Beacon “BC”, following Banks Channel through Green Markers “21” and “19” to a point on Topsail Beach near Fl. Beacon “18”, to include Virginia Creek and Stump Sound (see map).

All those waters in New River upstream of a line beginning at Hatch Point on the west shore, running easterly to Cedar Point on the east shore.

All those waters from the Intracoastal Waterway to the mainland between the Emerald Isle High Rise Bridge and Beacon “61A”, near Freeman Creek, to include Bear Creek, Queens Creek and the White Oak River.

The following also remains closed:

BRUNSWICK / NEW HANOVER / CARTERET COUNTIES

All those waters between Southport and the South Carolina State Line.

All those waters between IWW Channel Marker #141, near Peden Point and Snows Cut.
All those waters from the Intracoastal Waterway to the mainland between the Emerald Isle High Rise Bridge and Beacon “61A”, near Freeman Creek, to include Bear Creek, Queens Creek and the White Oak River.

Newport River - All those waters upstream of a line across the river from Crab Point to the southern end of the west shore of Core Creek.

GENERAL INFORMATION:

A. This proclamation is issued under the authority of N.C.G.S. 113-170.4; 113-170.5; 113-182; 113-221.1; 143B-289.52 and N.C. Marine Fisheries Commission Rules 15A NCAC 03H. 0103 and 03K .0101.

B. It is unlawful to violate the provisions of any proclamation issued by the N.C. Fisheries Director under his delegated authority pursuant to N.C. Marine Fisheries Commission Rule 15A NCAC 03H .0103.

C. This proclamation returns the following areas to normal closure boundaries: a portion of Topsail Sound, Old Topsail Creek, and the Bear Inlet and Browns Inlet areas.

D. These reopenings are due to satisfactory bacteriological sampling results.
