PROCLAMATION

RE: SHELLFISH POLLUTED AREA

Stephen W. Murphey, Director, Division of Marine Fisheries, upon the recommendation of Betsey Tilson, M.D., M.P.H., State Health Director, Department of Health and Human Services, hereby announces that the following shellfish area temporary closure will take effect immediately:

It is unlawful for any person to take or attempt to take any oysters, clams or mussels or possess, sell or offer for sale any oysters, clams or mussels taken from the following polluted area:

PENDER / ONSLOW COUNTIES

All those waters in Stump Sound between the North Topsail Beach High-rise Bridge and the Surf City Bridge.

The following also remains closed:

ONSLOW / CARTERET / DARE COUNTIES

Queens Creek - All those waters in Queens Creek upstream of a straight line across the mouth.

Newport River - All those waters in Newport River upstream of a straight line beginning at a point on the south shore at 34° 45.6646' N – 76° 44.0603’ W, at Lawton Point, running northerly to a point on the north shore at 34° 46.5724' N -76° 44.3786' W just upstream of Hammock Rock.

Stumpy Point Bay - All those waters within 100 yards of the dredge spoils effluent pipe near 35° 40.8395' N - 75° 46.4002' W in the southwestern part of Stumpy Point Bay.

GENERAL INFORMATION:

A. This proclamation is issued under the authority of N.C.G.S. 113-170.4; 113-170.5; 113-182; 113-221.1; 143B-289.52 and N.C. Marine Fisheries Commission Rules 15A NCAC 03H .0103 and 03K .0101.

B. It is unlawful to violate the provisions of any proclamation issued by the N.C. Fisheries Director under his delegated authority pursuant to N.C. Marine Fisheries Commission Rule 15A NCAC 03H .0103.

C. In accordance with N.C. General Statute 113-221.1(c) all persons who may be affected by proclamations issued by the Fisheries Director are under a duty to keep themselves informed of current proclamations.

D. This temporary closure is due to heavy rainfall and resultant runoff.
