PROCLAMATION

RE: SHELLFISH POLLUTED AREA


Braxton Davis, Director, Division of Marine Fisheries, upon the recommendation of Randall Williams, M.D., State Health Director, Department of Health and Human Services, hereby announces that the following changes in shellfish harvesting areas will take effect at sunrise, Saturday, March 18, 2017.

All those waters in Onslow and Carteret Counties will return to the status in existence immediately prior to the March 14, 2017, temporary closures except the following which remains closed:

ONSLOW / CARTERET COUNTIES


All those waters bordered on the northeast by a straight line from Swan Point through IWW Channel Marker #4 to the eastern tip of West Onslow Beach, (south shore of the New River Inlet), and bordered on the southwest by the Surf City Bridge.

All those waters, Intracoastal Waterway to the mainland, between the Emerald Isle High Rise Bridge and IWW Beacon “58”, near Bear Creek, to include Bear Creek, Queens Creek, and White Oak River.

Newport River – All those waters in Newport River upstream of the Highway 70 High Rise Bridge and Morehead-Beaufort Causeway, to include all tributaries and Core Creek.

North River - All those waters upstream of a straight line beginning at a point on the northwest shore of Goose Bay thence in a straight line across the river near the old Fl. "Danger" Beacon; thence to a point at 34°44.4581’N - 76°37.3826’ W; on the shore south of Cow Pen Creek to include all of Ward Creek.

Oyster Creek - All those waters in Oyster Creek upstream of the Hwy 70 Bridge.

The following also remains closed:

BRUNSWICK / NEW HANOVER / PENDER COUNTIES


All those waters between IWW Beacon "84" and the South Carolina Line, to include the Tubbs Inlet area.

All those waters between Southport and IWW Channel Marker #51A, near the Holden Beach Bridge, to include all of Lockwoods Folly River and the Lockwoods Folly River Inlet area.

All those waters within 100 yards from the dredge spoils effluent pipe at US Army Corps of Engineers Disposal Area #241, located approximately 250 yards south of Fl Beacon “122” near the Mason Creek and IWW crossing.

All those waters, Intracoastal Waterway to the mainland, from the Surf City Bridge to Snows Cut.

All those waters bordered on the northeast by a straight line from Swan Point through IWW Channel Marker #4 to the eastern tip of West Onslow Beach, (south shore of the New River Inlet), and bordered on the southwest by the Surf City Bridge.

GENERAL INFORMATION:

A. This proclamation is issued under the authority of N.C.G.S. 113-170.4; 113-170.5; 113-182; 113-221.1; 143B-289.52 and N.C. Marine Fisheries Commission Rules 15A NCAC 03H. 0103 and 03K .0101.

B. It is unlawful to violate the provisions of any proclamation issued by the N.C. Fisheries Director under his delegated authority pursuant to N.C. Marine Fisheries Commission Rule 15A NCAC 03H .0103.

C. In accordance with N.C. General Statute 113-221.1(c) all persons who may be affected by proclamations issued by the Fisheries Director are under a duty to keep themselves informed of current proclamations.

D. This proclamation returns the following areas to normal closure boundaries: Salliers Bay, Freeman Creek, a portion of the Intracoastal Waterway along Camp LeJeune, and a portion of North River.

E. These reopenings are due to satisfactory bacteriological sampling results.
