PROCLAMATION
RE: SHELLFISH POLLUTED AREA
Dr. Louis B. Daniel III, Director, Division of Marine Fisheries, upon the recommendation of Robin Cummings, M.D., Acting State Health Director, Department of Health and Human Services, hereby announces that the following shellfish area temporary closure will take effect immediately:
No person shall take or attempt to take any oysters, clams or mussels or possess, sell or offer for sale any oysters, clams or mussels taken from the following polluted areas:
NEW HANOVER COUNTY
All those waters in the basin approximately 200 yards west of IWW Beacon “140” upstream of a straight line beginning at a point 34° 8.1752’ N -77° 51.9495’ W on the north shore; running southerly to a point 34° 8.1582’ N -77° 51.9655’ W on the south shore (See Map).
The following also remains closed:
BRUNSWICK / ONSLOW COUNTIES
All those waters at Holden Beach, in the IWW between Beacon "71” near Shallotte River, and Beacon "63".
All those waters within 100 yards from the dredge spoils effluent pipe near Bald Head Island located approximately 200 yards north of the mouth of Bald Head Creek.
Freeman Creek - All those waters in Freeman Creek upstream of a straight line across the mouth.
GENERAL INFORMATION:
A. This proclamation is issued under the authority of N.C.G.S. 113-170.4; 113-170.5; 113-182; 113-221.1; 143B-289.52 and N.C. Marine Fisheries Commission Rules 15A NCAC 03H . 0103 and 03K .0101.
B. It is unlawful to violate the provisions of any proclamation issued by the N.C. Fisheries Director under his delegated authority pursuant to N.C. Marine Fisheries Commission Rule 15A NCAC 03H .0103.
C. This temporary closure is due to a dredging operation in the Masonboro Sound area of New Hanover County that is resulting in the discharge of water to an open shellfishing area.
