PROCLAMATION
RE: SHELLFISH POLLUTED AREA
Stephen W. Murphey, Director, Division of Marine Fisheries, upon the recommendation of Betsey Tilson, M.D., M.P.H., State Health Director, Department of Health and Human Services, hereby announces that the following changes in shellfish harvesting areas will take effect at sunrise, Saturday, February 3, 2018.
All those waters in New Hanover, Pender, Onslow, and Carteret Counties will return to the status in existence immediately prior to the January 29, 2018, temporary closures except the following which will remain closed:
PENDER / ONSLOW / CARTERET COUNTIES
All those waters bordered on the northeast by a straight line from Swan Point through IWW Channel Marker #4 to the eastern tip of West Onslow Beach, (south shore of New River Inlet), and bordered on the southwest by the Surf City Bridge.
All those waters from the Intracoastal Waterway to the mainland between IWW Marker “45”, near Swansboro, and IWW Marker “55”, near Goose Creek, to include Queens Creek and White Oak River.
Newport River - All those waters in Newport River upstream of the Highway 70 High Rise Bridge and Morehead-Beaufort Causeway, to include all tributaries and Core Creek.
North River – All those waters in North River upstream of a straight line beginning at a point on the northwest shore of Goose Bay; thence in a straight line across the river near the old Fl. "Danger" Beacon; thence to a point at 34°44.4581’N - 76°37.3826’ W on the shore, south of Cow Pen Creek to include all of Ward Creek.
Jarrett Bay - All those waters in Jarrett Bay upstream of a line beginning at a point on the east shore of Spit Bay; thence in a straight line to the northern tip of Davis Island; thence in a straight line to the "Chimney" near Jump Run Creek.
The following also remains closed:
BRUNSWICK / DARE COUNTIES
All those waters between IWW Marker "84" and the South Carolina Line, to include the Tubbs Inlet area.
Shallotte River - All those waters in Shallotte River upstream of a straight line from Bowen Point to Long Point.
All those waters between Southport and IWW Channel Marker #51A, near the Holden Beach Bridge, to include all of Lockwoods Folly River and the Lockwoods Folly River Inlet area.
Stumpy Point Bay - All those waters within 100 yards of the dredge spoils effluent pipe near 35° 40.8395' N - 75° 46.4002' W in the southwestern part of Stumpy Point Bay.
GENERAL INFORMATION:
A. This proclamation is issued under the authority of N.C.G.S. 113-170.4; 113-170.5; 113-182; 113-221.1; 143B-289.52 and N.C. Marine Fisheries Commission Rules 15A NCAC 03H. 0103 and 03K .0101.
B. It is unlawful to violate the provisions of any proclamation issued by the N.C. Fisheries Director under his delegated authority pursuant to N.C. Marine Fisheries Commission Rule 15A NCAC 03H .0103.
C. In accordance with N.C. General Statute 113-221.1(c) all persons who may be affected by proclamations issued by the Fisheries Director are under a duty to keep themselves informed of current proclamations.
D. This proclamation returns the following areas to normal closure boundaries: Myrtle Grove Sound, Masonboro Sound, Middle Sound, Topsail Sound, Salliers Bay, Freeman Creek, Bear Creek, the Intracoastal Waterway area between Fl. Beacon “65A” and IWW Beacon “55”, a portion of North River, Whitehurst Creek, Sleepy Creek, a portion of Jarrett Bay, Oyster Creek, Brett Bay, and Nelson Bay.
E. These reopenings are due to satisfactory bacteriological sampling results.
