PROCLAMATION

RE: SHELLFISH POLLUTED AREA


Dr. Louis B. Daniel III, Director, Division of Marine Fisheries, upon the recommendation of Robin Cummings, M.D., Acting State Health Director, Department of Health and Human Services, hereby announces that the following change in shellfish harvesting areas will take effect at sunrise, Thursday, March 13, 2014.

All those waters in Onslow and Carteret Counties will return to the status in existence immediately prior to the March 7, 2014, temporary closures except the following which will remain closed:

ONSLOW / CARTERET COUNTIES

All those waters from the Intracoastal Waterway to the mainland between Intracoastal Waterway Channel Marker #65A, located just west of Salliers Bay near New River Inlet, to IWW Marker #64, to include Salliers Bay.

Freeman Creek - All those waters in Freeman Creek upstream of a straight line across the mouth.

Bear Creek - All those waters in Bear Creek upstream of a straight line across the mouth.

Bogue Sound – All those waters from the IWW to the mainland between IWW Beacon “27” and IWW Fl. Beacon “25”, to include all of Broad Creek.

Newport River - All those waters in Newport River upstream of the Highway 70 High Rise Bridge and Morehead-Beaufort Causeway, to include all tributaries and Core Creek.

Ward Creek - All those waters in Ward Creek upstream of a line beginning at a point on the north shore at 34° 46.2667' N - 76° 35.4933' W, running southerly to a point on the south shore at 34° 45.4517' N - 76° 35.1767' W. (Ward Creek DMF Shrimp Line).

The following also remains closed:

BRUNSWICK / CARTERET COUNTIES

All those waters between Southport and the South Carolina state line.

Hoop Pole Creek - All those waters in the Hoop Pole Creek area upstream of a line beginning on a point of marsh at 34°42.4519’ N -76°45.1967’ W; running southeasterly across the bay to a point of marsh at 34°42.4429’ N -76°45.1829’ W; running southeasterly following the shoreline to a point at 34°42.4069’ N -76°45.1285’ W; running southeasterly across the creek to a point 34°42.3984’ N -76°45.1098’ W on the eastern shore.

GENERAL INFORMATION:

A. This proclamation is issued under the authority of N.C.G.S. 113-170.4; 113-170.5; 113-182; 113-221.1; 143B-289.52 and N.C. Marine Fisheries Commission Rules 15A NCAC 03H . 0103 and 03K .0101.

B. It is unlawful to violate the provisions of any proclamation issued by the N.C. Fisheries Director under his delegated authority pursuant to N.C. Marine Fisheries Commission Rule 15A NCAC 03H .0103.

C. This proclamation returns the following areas to normal closure boundaries: IWW to the mainland between IWW Marker #64 and the Emerald Isle High-Rise Bridge (except Freeman and Bear Creeks), Queens Creek, White Oak River, and a portion of North River (except Ward Creek).

D. These reopenings are due to satisfactory bacteriological sampling results.
