PROCLAMATION
RE: SHELLFISH POLLUTED AREA
Stephen W. Murphey, Director, Division of Marine Fisheries, upon the recommendation of Betsey Tilson, M.D., M.P.H., State Health Director, Department of Health and Human Services, hereby announces that the following changes in shellfish harvesting areas will take effect at sunrise, Thursday, November 29, 2018.
All those waters in Pamlico County will return to the status in existence immediately prior to the November 13, 2018, temporary closures except the following which will remain closed:
PAMLICO COUNTY
Bay River - All those waters in Bay River upstream of a line beginning at a point 35° 10.7969' N - 76° 36.7833' W on the north shore near Spencer Point, running southerly to a point 35° 09.6952' N - 76° 36.6683' W on the south shore.
The following also remains closed:
BRUNSWICK / NEW HANOVER / PENDER / ONSLOW / CARTERET COUNTIES
All those waters between IWW Beacon “1” near Southport and the South Carolina State Line.
All those waters in Myrtle Grove Sound bordered on the north by a line beginning at a point 34° 04.8476’N - 77° 53.0990’ W on the mainland; running easterly near IWW Marker “155” to the southern tip of Masonboro Island at 34° 04.8251’N - 77° 52.9092’ W; and bordered on the south by Snows Cut.
All those waters from the Intracoastal Waterway to the mainland between IWW Marker “141” (34° 07.7515’N - 77° 51.9560’ W) near Peden Point and IWW Marker “155” (34° 04.8189’N - 77° 52.9654’ W) near Carolina Beach Inlet.
All those waters in Masonboro Sound and Middle Sound bordered on the north by the Figure Eight Island Bridge; and bordered on the south by a line beginning at a point 34° 07.7706’N - 77° 52.0833’ W on the mainland near Peden Point; running easterly near IWW Marker “141” to a point 34° 07.6007’N - 77° 51.0328’ W on Masonboro Island.
All those waters from the Intracoastal Waterway to the mainland between IWW Marker “105” (34° 19.4274’N - 77° 42.9507’ W) near Green Channel and the Figure Eight Island Bridge.
Queens Creek - All those waters in Queens Creek upstream of a straight line across the mouth, beginning at a point 34° 39.8479’N - 77° 09.1171’ W on the west shore; running northeasterly to a point 34° 40.2031’N - 77° 08.4408’ W on the east shore near the State Park Boat Ramp.
White Oak River - All those waters in White Oak River upstream of the Highway 24 Bridge at Swansboro.
Bogue Sound - All those waters from the Intracoastal Waterway to the mainland in Bogue Sound between IWW Marker “24” and IWW Marker “33”, to include Sanders Creek and Broad Creek.
Newport River - All those waters in Newport River upstream of the Highway 70 High Rise Bridge and the Morehead-Beaufort Causeway, to include all tributaries and Core Creek.
North River - All those waters upstream of a straight line beginning at a point 34° 44.4581’N - 76° 37.3826’ W on the shore south of Cow Pen Creek; running easterly near the old Fl. "Danger" Beacon to a point 34° 44.4929’ N - 76° 35.3320’ W on the northwest shore of Goose Bay, to include all of Ward Creek.
Whitehurst Creek – All those waters in Whitehurst Creek upstream of a straight line across the mouth, beginning at a point 34° 43.5146' N - 76° 33.3428' W on the west shore; running easterly to a point 34° 43.5511' N - 76° 33.1664' W on the east shore.
Wade Creek – All those waters in Wade Creek upstream of a straight line across the mouth, beginning at a point 34° 46.3554’ N - 76° 29.9593’ W on the north shore; running southerly to a point 34° 45.9666’ N - 76° 30.0140’ W on the south shore.
GENERAL INFORMATION:
A. This proclamation is issued under the authority of N.C.G.S. 113-170.4; 113-170.5; 113-182; 113-221.1; 143B-289.52 and N.C. Marine Fisheries Commission Rules 15A NCAC 03H. 0103 and 03K .0101.
B. It is unlawful to violate the provisions of any proclamation issued by the N.C. Fisheries Director under his delegated authority pursuant to N.C. Marine Fisheries Commission Rule 15A NCAC 03H .0103.
C. In accordance with N.C. General Statute 113-221.1(c) all persons who may be affected by proclamations issued by the Fisheries Director are under a duty to keep themselves informed of current proclamations.
D. This proclamation returns the following areas to normal closure boundaries: Bonner Bay, a portion of Bay River and Gale Creek (Pamlico County).
E. These reopenings are due to satisfactory bacteriological sampling results.
