PROCLAMATION

RE: SHELLFISH POLLUTED AREA 


Dr. Louis B. Daniel III, Director, Division of Marine Fisheries, upon the recommendation of Megan Davies, M.D.,Acting State Health Director, Department of Health and Human Services, hereby announces that the following changes in shellfish harvesting area will take effect at sunrise, Sunday, December 6, 2015.

All those waters in Pender and Onslow County will return to the status in existence immediately prior to the September 28, November 10, and November 20, 2015, temporary closures except the following which will remain closed:

PENDER / ONSLOW COUNTIES

All those waters, from the IWW to the mainland between IWW Marker “82” near Watts Landing and the Surf City Bridge, to include Beckys Creek.

All those waters bordered on the southwest by a line beginning at a point on the mainland near Morris Landing; running southeasterly through IWW Beacon “49” to a point on Topsail Island at 34° 27.273’ N -77° 29.937’ W and bordered on the northeast by a line beginning at a point on the mainland near Thomas Landing; running southerly through IWW Marker “37” to a point on the tip of Ashe Island at 34° 28.865’ N -77° 28.509’ W, to include all of Permuda Island and a portion of Stump Sound.

Queens Creek - All those waters in Queens Creek upstream of a straight line across the mouth.

The following also remains closed:

NEW HANOVER / CARTERET COUNTIES

All those waters bordered on the south by a line beginning at a point on the mainland near Old Chimney Marina; running easterly through IWW Beacon #154” to a point on the southern tip of Masonboro Island at 34° 4.9884’ N -77° 52.3178’ W and bordered on the northeast by a line beginning at a point on the mainland between Whiskey Creek and Hewlett’s Creek; running easterly through IWW Beacon “134” to a point on Masonboro Island at 34°9.7856’ N -77° 49.8845’ W; to include portions of Myrtle Grove Sound and Masonboro Sound.

Bogue Sound - All those waters, from the IWW to the mainland in Bogue Sound between IWW Marker “32” near Sanders Creek and IWW Marker “20” near Gales Creek, to include Sanders Creek, Broad Creek, and Gales Creek.

Newport River - All those waters in Newport River upstream of a line across the river from Crab Point to the southern end of the west shore of Core Creek.

Oyster Creek - All those waters in Oyster Creek upstream of a straight line across the mouth.

GENERAL INFORMATION:

A. This proclamation is issued under the authority of N.C.G.S. 113-170.4; 113-170.5; 113-182; 113-221.1; 143B-289.52 and N.C. Marine Fisheries Commission Rules 15A NCAC 03H. 0103 and 03K .0101.

B. It is unlawful to violate the provisions of any proclamation issued by the N.C. Fisheries Director under his delegated authority pursuant to N.C. Marine Fisheries Commission Rule 15A NCAC 03H .0103.

C. This proclamation returns the following area to normal closure boundaries: A portion of Topsail Sound,Virginia Creek, and a portion of Stump Sound.

D. These reopenings are due to satisfactory bacteriological sampling results.
