PROCLAMATION

RE: SHELLFISH POLLUTED AREA


Dr. Louis B. Daniel III, Director, Division of Marine Fisheries, upon the recommendation of Megan Davies, M.D., Acting State Health Director, Department of Health and Human Services, hereby announces that the following changes in shellfish harvesting areas will take effect at sunrise, Wednesday, November 18, 2015.

All those waters in Brunswick, New Hanover, Onslow, and Carteret Counties will return to the status in existence immediately prior to the November 3, November 5, November 8, and November 10, 2015, temporary closures except the following which will remain closed:

BRUNSWICK / NEW HANOVER / ONSLOW / CARTERET COUNTIES

Lockwoods Folly River - All those waters north of a line beginning on the west shore at a point 33°55.7954’N - 78°13.3096’ W approximately midway between Genoes Point and Spring Creek; running southeasterly to a point 33°55.2284’N - 78°12.7791’ W near the northwest point of Horse Island, to include the open portion of the Atlantic Intracoastal waterway north of Horse Island.

All those waters between Snows Cut and IWW Channel Marker #141, near Peden Point.

All those waters in Stump Sound between IWW Marker “37”, near Everett Bay, and IWW Marker “49”, near Morris Landing.

Newport River - All those waters in Newport River upstream of a straight line beginning at a point on the shore at 34° 45.6646' N – 76° 44.0603’ W, at Lawton Point; thence to a point on the north shore at 34º 46.5724' N -76º 44.3786' W just upstream of Hammock Rock.

The following also remains closed:

HYDE COUNTY

All those waters in Swanquarter Bay upstream of a line beginning at a point on the west shore at 35° 24.6204’ N -76° 21.0791’ W; running southeasterly to a point on the east shore at 35° 24.5704’ N -76° 20.9404’ W.

GENERAL INFORMATION:

A. This proclamation is issued under the authority of N.C.G.S. 113-170.4; 113-170.5; 113-182; 113-221.1; 143B-289.52 and N.C. Marine Fisheries Commission Rules 15A NCAC 03H. 0103 and 03K .0101.

B. It is unlawful to violate the provisions of any proclamation issued by the N.C. Fisheries Director under his delegated authority pursuant to N.C. Marine Fisheries Commission Rule 15A NCAC 03H .0103.

C. This proclamation returns the following areas to normal closure boundaries: Tubbs Inlet area, Shallotte River, a portion of Masonboro Sound, a portion of Stump Sound, Freeman Creek, Bear Creek, Queens Creek, White Oak River, Banks Channel area (Carteret County), and a portion of Newport River.

D. These reopenings are due to satisfactory bacteriological sampling results.
