PROCLAMATION

RE: SHELLFISH POLLUTED AREA


Dr. Louis B. Daniel III, Director, Division of Marine Fisheries, upon the recommendation of Megan Davies, M.D., Acting State Health Director, Department of Health and Human Services, hereby announces that the following changes in shellfish harvesting areas will take effect at sunrise, Sunday, November 15, 2015.

All those waters in Onslow and Carteret Counties will return to the status in existence immediately prior to the November 5, and November 10, 2015, temporary closures except the following which will remain closed:

ONSLOW AND CARTERET COUNTIES

All those waters bordered on the northeast by a straight line from Swan Point through ICWW Channel Marker #4 to the eastern tip of West Onslow Beach, (south shore of New River Inlet), and bordered on the southwest by IWW Marker “49” near Morris Landing, to include Everett Bay, Alligator Bay, and Chadwick Bay.
 
Freeman Creek – All those waters in Freeman Creek upstream of a straight line across the mouth.

Bear Creek – All those waters in Bear Creek upstream of a straight line across the mouth.

All those waters bordered on the southwest by a line starting at the mainland running south through Flashing Beacon “55”, following Sanders Creek to the south tip of Bear Island, and bordered on the northeast by a line starting at a point on the mainland running southeast through the Turn Marker at Cow Channel, following Cow Channel to the Ferry Landing at Hammocks Beach.

All those waters, from the IWW to the mainland, from the Turn Marker at Cow Channel to ICWW Channel Marker “49”, to include Queens Creek.

White Oak River - All those waters in White Oak River upstream of the Highway 24 Bridge at Swansboro.

All those waters from Banks Channel to Emerald Isle between the Emerald Isle High-rise Bridge and a point 34° 39.8010' N - 77° 04.8421' W near the Spinnakers Landing Subdivision.

Newport River - All those waters in Newport River upstream of a line beginning near Penn Point on the south shore at a point 34° 45.6960' N - 76° 43.5180' W running northeasterly to a point 34° 46.5733' N - 76° 42.6350' W on the north shore near Hardesty Farms subdivision.

The following also remains closed:

BRUNSWICK / NEW HANOVER / HYDE COUNTIES


All those waters between Southport and the South Carolina state line.

All those waters between Snows Cut and IWW Channel Marker #141, near Peden Point.

All those waters, from the IWW to the mainland, between the Wrightsville Beach southern permanent closure line and IWW Beacon #141, near Peden Point.

All those waters in Swanquarter Bay upstream of a line beginning at a point on the west shore at35° 24.6204’ N -76° 21.0791’ W; running southeasterly to a point on the east shore at 35°24.5704’ N -76° 20.9404’ W.

GENERAL INFORMATION:

A. This proclamation is issued under the authority of N.C.G.S. 113-170.4; 113-170.5; 113-182; 113-221.1; 143B-289.52 and N.C. Marine Fisheries Commission Rules 15A NCAC 03H. 0103 and 03K .0101.

B. It is unlawful to violate the provisions of any proclamation issued by the N.C. Fisheries Director under his delegated authority pursuant to N.C. Marine Fisheries Commission Rule 15A NCAC 03H .0103.

C. This proclamation returns the following areas to normal closure boundaries: Salliers Bay, a portion of the Intracoastal Waterway, North River, Jarrett Bay, and Nelson Bay.

D. These reopenings are due to satisfactory bacteriological sampling results.
