PROCLAMATION

RE: SHELLFISH POLLUTED AREA


Dr. Louis B. Daniel III, Director, Division of Marine Fisheries, upon the recommendation of Megan Davies, M.D., Acting State Health Director, Department of Health and Human Services, hereby announces that the following changes in shellfish harvesting areas will take effect at sunrise, Saturday, November 14, 2015.

All those waters in Carteret County will return to the status in existence immediately prior to the November 5, and November 10, 2015, temporary closures except the following which will remain closed:

CARTERET COUNTY

All those waters, from the IWW to the mainland, from the Turn Marker at Cow Channel to the Emerald Isle High-rise Bridge, to include Queens Creek, and White Oak River.

All those waters from Banks Channel to Emerald Isle between the Emerald Isle High-rise Bridge and a point 34° 39.8010' N - 77° 04.8421' W near the Spinnakers Landing Subdivision.

Newport River - All those waters in Newport River upstream of a line beginning near Penn Point on the south shore at a point 34° 45.6960' N - 76° 43.5180' W running northeasterly to a point 34° 46.5733' N - 76° 42.6350' W on the north shore near Hardesty Farms subdivision.

North River – All those waters in North River upstream of a line beginning at a point on the west shore at 34° 46.0383' N - 76° 37.0633' W, running easterly to a point on the east shore at 34° 46.2667' N - 76° 35.4933' W. (North River DMF Shrimp Line).

Jarrett Bay - All those waters upstream of a line beginning at a point on the east shore of Spit Bay; thence in a straight line to the southern end of Davis Island; thence in a straight line thru Flashing Beacon #36; thence in a straight line to the southeast end of Bells Island; thence in a straight line to a point on the Marshallberg shoreline.

Nelson Bay - All those waters in Nelson Bay upstream of a line from Drum Point to the northern tip of Fulchers Creek.

The following also remains closed:

BRUNSWICK / NEW HANOVER / ONSLOW / HYDE COUNTIES

All those waters between Southport and the South Carolina state line.

All those waters between Snows Cut and IWW Channel Marker #141, near Peden Point.

All those waters, from the IWW to the mainland, between the Wrightsville Beach southern permanent closure line and IWW Beacon #141, near Peden Point.

All those waters bordered on the northeast by a straight line from Swan Point through ICWW Channel Marker #4 to the eastern tip of West Onslow Beach, (south shore of New River Inlet), and bordered on the southwest by IWW Marker “49” near Morris Landing, to include Everett Bay, Alligator Bay, and Chadwick Bay.

All those waters from Fl. Beacon “65A”, located just west of Salliers Bay, near New River Inlet, to a line starting at a point on the mainland running southeast through the Turn Marker at Cow Channel, following Cow Channel to the Ferry Landing at Hammocks Beach, to include Salliers Bay, Freeman Creek, and Bear Creek.

All those waters, from the IWW to the mainland, from the Turn Marker at Cow Channel to the Emerald Isle High-rise Bridge, to include Queens Creek, and White Oak River.

All those waters in Swanquarter Bay upstream of a line beginning at a point on the west shore at 35° 24.6204’ N -76° 21.0791’ W; running southeasterly to a point on the east shore at 35° 24.5704’ N -76° 20.9404’ W.

GENERAL INFORMATION:

A. This proclamation is issued under the authority of N.C.G.S. 113-170.4; 113-170.5; 113-182; 113-221.1; 143B-289.52 and N.C. Marine Fisheries Commission Rules 15A NCAC 03H. 0103 and 03K .0101.

B. It is unlawful to violate the provisions of any proclamation issued by the N.C. Fisheries Director under his delegated authority pursuant to N.C. Marine Fisheries Commission Rule 15A NCAC 03H .0103.

C. This proclamation returns the following areas to normal closure boundaries: a portion of North River, Whitehurst Creek, Sleepy Creek, Oyster Creek, and Brett Bay.

D. These reopenings are due to satisfactory bacteriological sampling results.
